Squire Thomas was murdered by British sympathizers in South Carolina in 1778.

NOTES FROM GEDCOM DATABASE:
After Squire Thomas Choate was killed by Tories, his family continued to live at their home outside the "Settlement" in South Carolina. Indians were a source of danger and fear for the colonists at this time, especially to those who sought to live away from the "settlement" Warning of an Indian raid came one day while Elizabeth Choate was weaving cloth to make clothing for her children. Thet left hurriedly for the "settlement" leaving their home and belongings to the mercies of the Indians. When the danger was passed, she felt it her duty to return and investigate the results of the raid. She prepared food for her and one of her sons, who was armed with a shotgun, and returned to the cabin home which had luckily escaped destruction. While the son stood guard outside the house and watched for any sign of danger, she wove cloth, never stopping for two days and nights except to eat of the food they had brought. Upon completion of the web of cloth, she cut it from the loom and they hurriedly and safely returned to the settlement.

Court case (from Paula at Rootsweb Choate List):
JUDITH HOLSTEIN vs DAVID CHOAT
She represents that a certain David Choat has carried off her daughter, wife of Thomas Holms, and the child of said Holmes has also been carried off by said David Choat and her daughter. Said Choat is a man of infamous conduct in other respects, having stolen horses in the Province of Cumberland. She prays that consideration for the mother of a family and order that said Choat desist from having intercourse and all connection with her daughter and that the child of said daughter may be placed under the care and protection of your petitioner.

Notes for ISAAC CHOATE:
[choate2.ged]

Revolutionary War Pay Voucher #2384 State of North Carolina.

Isaac was charged for stealing horses in August 1784 in Washington County, Tennessee. "He threw himself on the mercy of the court". Sid Cox said, "But we must remember some things. For eight years the nation had been at war with England. The Choates and other patriots in that part of the country were living amongst many English-sympathizing Americans who would betray them to the enemy if they had a chance. It was a time of lawlessness when the two sides fought each other and appropriated each other's property as enemies. I suspect that our kinsman regarded stealing the horses as evening up the score with some Tory who had done him, or his kinsmen, wrong. History does show that the jjudge who sentenced him to death was a highhanded man much hated by the people of the county and that the jury that tried Isaac recommended leniency. My guess is that the Choates took the Washington County jailhouse apart and sent Isaac off to some of the kinfolks. The Choates had been in Washington and Sullivan Counties for a long time, and very shortly after this they began to sell out and go elsewhere."

"The legatees of the Estate of Thomas Choate deceased produced in court an agreement between them which having been duly proven was ordered to be recorded in the words & figures followinf to wit:

"State of Tennessee, Lawrence County June 24th 1837 whereas Thomas Choat in his lifetime executed his last will & testament and afterwards became dissatisfied with said will and expressed his intention to alter it but did not, owing to his sickness & whereas great difficulties and lawsuits are about to spring up between the heirs & legatees of said estate and which will be wholly ruinous to the heirs & legatees of said estate and in effect make the lawyers & officers of Court the true heirs of said estate, now for the purpose of preventing said result we the rightful heirs do mutually agree that said estate both real and personal shall descend as though Thomas Choat our ancestor had died without a will and that said estate shall be administered on in the same way as if Thomas Choat had died intestate. But in as much as we all know that it always was the wish of our ancestor Thomas Choat to give Edward more than any of us, in consideration thereof we, to wit, James R. Choat & his wife, Prudence, John D. Shoat, James Hollis and his wife, Rhody, Nancy Barefoot and Susannah Choat, nine in all agree to pay Edward fifty dollars each out of our shares, making Edward's share four hundred and fifty dollars more than any of our shares. In testimony whereof we have hereunto set our hands & affixed our seals this 24 day of June 1837"

"To the Honorable the General Assembly of the State of Tennessee now in session.

"The petition of Nancy Barefoot most Humbly sheweth that your petitioner intermarried with Dillon W. H. Barefoot in the year 1817. That about six months after our marriage and before we became housekeepers my said husband took to rambling and your petitioner hearing of him at Knoxville went from her father's house in Maury County to that place in hopes to engage his attention and induce him to settle, he promised to do so and we settled in Sequatchie valley but he having no dosposition to provide a living by industry I soon became in a distressed situation from poverty and went and returned to my father's house again in Maury County. In the course of last year I made another attempt to settle with him & try to make our living but within a few months he determined again to ramble & I once more returned to my father, he having declared his intention to go to South America and join the patriots & your petitioner not having heard of him in the course of this year, and being fully persuaded from former experience that he has no disposition to locate himself anywhere or use any existence to support wife and child, most humbly prays that your honourable body will grant her a divorce from her said husband, and your petitioner as in duty bound will ever pray."

Nancy Barefoot

"State of Tennessee, Maury County."

"We the undersigned subscribers do certify that we have been acquainted with Dillin Barefoot about the time he was married to Nancy Choate the above petitioner, that he staid in the neighborhood but a few months after his marriage, and after that only settled down a few times after being absent several months. And we do further certify that we believe the statements made in the above petition to be true."

From WFT. "Following is a story about 'Sally Gresham' sister of Squire Esward Choate (b. 1819), related by Patrick C. choate (b. 1892) of Cleveland, Texas, as told by his father, James Rufus Choate (b. 1843). This incident must have taken place some time in the Civil War and presumably the 'Aunt Sally' in this story is Sarah Choate, sister of Squire Edward Choate, who married Ephraim Gresham. 'Her house was on a hillside looking downhill from the front porch. She and one of her sisters-in-law were at home by themselves. A Company of Yankee (negro) soldiers came thru. Aunt Sally had lots of chickens. The negroes were hungry for chicken, so it seems. One took after a hen running to the front porch. When he stooped over to follow said hen under porch, Aunt Sally had a stick of firewood in her hand and struck said negro across the back of his neck and broke the negro's neck. Her sister-in-law almost had a fit and Sally told her off and said, 'I'll kill another if I have the chance.' The Yankee captain came and asked who killed the negro and why. She told him all that took place. He said, 'Good, kill another one if they bother you.' She told him not to woprry. He laughed and said he had no worries coming. He placed a soldier on guard and had the dead negro buried in the woods across from her house."

Notes for JAMES TRIMBLE:
[choate2.ged]

From Barbara Rivas As told by Annie Pearl Barefoot Daugherty Aug. 20, 1950:
"Jim Trimble killed a man down in Bee County, Texas. Old Uncle Monroe Choate lived there. (He had come down there from Arkansas. All those Choates had come there from Tennessee to Arkansas, and then on to Southern Texas.) They were wealthy cattlemen then. His son, Bing Choate, drove cattle to Dodge City, Kansas and was shot and killed the next morning after he sold them. Somebody shot him for his money. They got behind a goods box on the sidewalk and waited till he passed and shot him in the back. Old man Grant Vinson was up there when it happened. He told Pa that Bing Choate had the best bunch of cattle that he ever saw in his life. Bing Choate is buried right there in Boot Hill.

"Jim Trimble ran away up to Bell County. He was in jail and they were going to hang him. He broke out of jail some way and he got to Aunt Polly Choate, his grandma. His mother was a Choate. Aunt Polly was a Choate. (Or friends let him out. We don't know that part.) He got into some trouble down there in Bee County and he came off up to Erath County to some of those Choates. And he was always a looking for his brother-in-law, Dave Pinson, he was going to kill him if he found him. His wife was named Signa Pinson and she was Jim Trimble's sister. He never found that man. He got in trouble and killed an officer. While he was on the scout and looking for his brother-in-law. His brother-in-law had killed Jim Trimble's father and Jim had wanted to kill him since he was a little boy. Old Monroe Choate had goven him a gun and said, 'If you ever see him stick this right in his ear and don't let him know you are there and pull the trigger.' He was dressed like a Mexican with black pants and a red sash around his waist and spurs and boots and looked odd and foreign to those people there. They got to making inquiry because he was lying around at Aunt Polly's and not doing anything and they found that there was a man wanted for some kind of trouble down at Bee County and the sheriff took a notion that he would go and arrest this man. Anyhow, he went and he deputized some man to help him, just a neighbor, you know a sheriff can do that, and they went to old Aunt Polly Choate's house and Jim said that he took his belt and pistol off and had hung them on the side of the bed and was sitting on the side of the bed eating pecans and the officer walked in and pulled his gun on Jim and fired it and said 'Consider yourself under arrest', and he had fired before he ended his sentence. He was afraid of Jim. Jim got his pistol and killed the officer. He went out the door and the deputized man was there with his gun and Jim shot him in the forehead as he passed him. He said, 'I saw the hair curl into the bullet as I shot him.' The neighbors found him right away and they were all mad and put him in jail. They tied him and laid him down in the store and they spit ambeer (that's chewing tobacco) on him until he didn't know the color of his coat. They spit on him all evening long. Then they put him in jail. I don't know how he got out. I don't know how he got ahold of Pa (Pa was John Wiley Barefoot, grandson of Nancy Choate) and Aunt Polly and got them together. Some of those Choates probably got her down at Grandpa's. (Grandpa was John Tipton Barefoot, son of Nancy Choate). Pa drove a wagon and team and they put a feather bed in the back and Jim lay undeer it. Pa said he was on of the finest looking young men he ever saw in his life. Pa said he had a full red mustache. Aunt Polly sat beside Pa and knit socks all along the way and Pa drove the wagon and at night Jim would get out and walk to exercise. They got to Monroe Choate's and Jim said, 'I came to see what I had better do.' and Monroe said, 'If you stand trial they'll hang you, so you'd better get away.' He got away to Old Mexico and never has been heard of any more. His mother took a cancer in her breast and she had an operation and died from it. Pa was always afraid to have a cancer operated on after that."

Could this be Ammy Hamilton or another wife? I have birth date for Ammy as 1794 and she has Elizabeth's birth date as April 15, 1813, Carter County, Kentucky. Since, apparently, Zachariah is the last child given, Richard may have married again, but Ammy died 1852 and Zack was born 1831.

[choate2.ged]

From Bruce E. Logan - Ohio.
"Ellora Hinton in her 'My Best Recollections' recalls the tragic kidnapping of Mary by Jim Oakley, who carried her off to Missouri, where he beat her, abused her, and tried to kill her. She would have been about 17 or 18 at the time."
"In other versions, it was a Lucas (first or last name, couldn't recall), and she had sprung willingly up on the horse, more of an elopement than a kidnapping. Of Course, parts of both stories could be true, but evidently she was returned or escaped and never married, dying quite young."
