At a Surrogate Court held in & for the County of Onondaga, at Manlius, the 18th day of February, A.D. 1837.

Present, J. Fleming Junr., Surrogate –
In the matter of the Real Estate of Peter McQueen deceased -It satisfactorily appearing to this Court, that John McQueen, Harriet McQueen, Charlotte McQueen, Catherine McQueen, James McQueen, Hiram McQueen, Christian Ann McQueen, Henry McQueen, Oliver McQueen, & Margaret Hodges, and Peter McQueen, Eliza McQueen, Caroline McQueen, & Mary McQueen, all of said county of Onondaga, are respectively minors, & heirs of law of Peter McQueen late of said county, deceased, and that due & legal notice has been given them for this purpose: It is therefore ordered, that John Bowman, Esq. of Van Buren in said county, a disinterested freeholder, be, & be hereby is appointed guardian ad litem, for the sole purpose of appearing for, & taking care of the interests of said minors, in the proceeding now pending in this Court, to mortgage, lease or sell the real Estate of said deceased, to pay his debts –

In the matter of the Real Estate of Peter McQueen deceased. On reading & filing the petition of Betsy McQueen, administratrix of the Estate of Peter McQueen late of the town of Salina in said County, deceased, from which it appears among the things, that the personal Estate of the said deceased, is insufficient to pay his debts; that all of such Estate, which could have been applied to the payment of his debts; has been applied to that purpose, and that there yet remain debts due & unpaid: It is ordered, that all persons interested in the Estate of the said deceased, be, and they hereby are cited to appear at a Surrogate Court to be held at the Surrogate Office in Manlius, on Monday the tenth day of April next, at ten oÂ’clock in the fore noon, and show cause if any they have, why authority should not be given to said administratrix, to mortgage, lease or sell all the real Estate of which said deceased died seized or processed, or so much thereof as may be necessary to pay his debts, -

Disposition of the Real Estate of Peter McQueen

At a Surrogate Court held in & for the county of Onondaga, at Manlius the 11th day of April, A.D. 1837. Present – J. Fleming Junr., Surrogate –
In the matter of the Real Estate of Peter McQueen deceased. On reading & filing affidavits of the due service & publication of the order to show cause, hereto fore entered in this matter, and upon an Examination of all the proceedings therein; the Surrogate being satisfied that the requirements of the law have been all respects complied with in order to a decree therein; and further that the debts, for the purpose of satisfying which, the application has been made and justly due & owing, and that they are not secured by Judgement or Mortgage upon or expressly charged on the Real Estate of said Peter McQueen deceased; and further that the personal Estate of the said deceased is insufficient to pay his debts, and that the whole of such Estate, which could have been applied to the same; and that yet remain debts due & unpaid: and it further satisfactorily appearing to the Surrogate, that the money required to satisfy the debts of the said deceased can not be raised by mortgage or lease advantageously to the Estate: It is therefore ordered, on motion of Betsy McQueen administratrix of the Estate of said deceased, that said administratrix, she having filed the bond required by law, do & shall sell at public auction all the Eight (sic. Estate?) & interest which the said deceased had at the time of his death under and by virtue of a certain contract or certificate given by the Comptroller of the State of New York, to George Vosler, & by said George Vosler assigned to said Peter McQueen in his lifetime, which contract was for the purchase of the following real Estate, towit, the north half of Lot number seven in the Onondaga Salt Spring Reservation, containing Ninety nine & a half acres of land, bounded north by H. G. Stiles’ lands, East by David A. Earll’s lands, South by Jesse Pease’s land, & West by William Smith’s land; which premises are now in occupation of the said Betsy McQueen, & on which there is a suitable dwelling house & barn – And it is further ordered, that before any sale be made of said real Estate or any part thereof, the said administratrix shall give notice of the time & place of such Sale, by posting the same in three of the most places in the town of Salina for six weeks, and shall also publish the same in one of the newspapers printed in the County of Onondaga, for six successive weeks, at least once in Each Week.

And it is further ordered that upon such sale or sales, the said administratrix may give such length of credit, not exceeding three years; for not more than three fourths of the purchase money, as she may deem best calculated to produce the highest price to be approved by the Surrogate –

And it is further Ordered, that before any conveyance be executed of said real Estate or any part thereof, the said administratrix shall make Report to the Surrogate of the proceedings upon this order, immediately after such sale or sales for further directions -

Disposition of the Real Estate of Peter McQueen

In the matter of the Real Estate of Peter McQueen deceased. Whereas, Betsy McQueen administratrix of the Estate of Peter McQueen deceased, having made return to me the said Surrogate, after proceedings in the Sale of the interest which said deceased had in & to thirty nine & a half acres of land on farm Lot number Seven in the tract of land known by the name of the Onondaga Salt Spring Reservation, under & by virtue of a certificate from the Comptroller of the State of New York, to one George Vosler to the said Peter McQueen deceased in his life time, by an assignment thereon bearing date, March 2nd, 1824., & by said George Vosler to the said Peter McQueen deceased in his life time, by an assignment thereon bearing date the 7th day of June, 1831.; which said sale was made in pursuance of a Surrogate Order leaving date, April 11th, 1837., which said return of said administratrix is now on file in the Surrogate Office of said County; And I the said Surrogate having examined the said proceedings, and it appearing to me that the said Sale was legally made & fairly conducted; that said interest of the said deceased sold for a fair price, and that the sum bid therefor & for which it sold, was not disproportionate to the value thereof: I do therefore Confirm the said sale, and order that the said administratrix a conveyance assignment of the said Certificate or contract to Thomas McNamara the purchaser thereof, or hie legal representatives, agreeably to the terms of said sale, on his complying with said terms –
