The last will and testament of John Stuart of the town of Cameron County of Steuben and State of New York. I John Stuart considering the uncertainty of this mortal life and being of sound mind and memory (blessed be Almighty God for the same) do make and publish this my last will and testament in manner and form following that is to say:

First, I give and bequeath unto my beloved wife Cynthia Stuart the whole of my farm and property thereon. Second. I give and bequeath to my two sons John S. Stuart and Abraham Stuart the whole of my farm lying in the town of Cameron and in the County and State aforesaid to be divided equally to John S. Stuart and Abraham Stuart together with all the loose property on said farm, it being the farm that I now live on. I further appoint my beloved wife Cynthia Stuart if she should out-live me my executrix of this my last will and testament. And lastly my express will and meaning is and I do hereby order and appoint that if any difference, dispute, question or controversy shall be moved, arise or happen concerning any gift bequest matter or thing in this my will given and bequeathed expressed or contained that then no suit or suits in law or equity or otherwise shall be brought, commenced or prosecuted for and concerning the same but the same shall be refused wholly to the the award order and determination of my friend John Stout of Urbana Steuben County and State of New York and Chancey Boys of the town of Barrington and of the County of Yates and State of New York and what they shall order, direct or determine therein shall be binding and conclusive to all and every person and persons concerned. In witness whereof I have hereunto set my hand and seal the 14th day of November in the year of our Lord one thousand eight hundred and forty-six.

The above instrument consisting of one sheet was now here subscribed by John Stuart the testator in the presence of each of us and was at the same time declared by him to be his last will and testament and we at his request sign our names hereto as attesting witnesses.

The foregoing being the last will and testament of John Stuart, deceased, and relating to both real and personal estate, together with the proofs of the execution thereof taken before me, was recorded and is hereby signed and certified by me this 15th day of December one thousand eight hundred and sixty-two.
