JAMES AND ANN PILCHER AND SON STEPHEN PILCHER LEASE LAND FROM BERTRAND EWELL 1774

1774, 19 Nov: Indenture, BERTRAND EWELL and JESSE EWELL of Prince William County, Virginia lease to JAMES PILCHER of the same place, assigns during the life of the sd. JAMES PILCHER his wife ANN and his son STEPHEN PILCHER & during the life of the longest liver of them. He the sd. JAMES PILCHER his heirs or assigns the sum of four pounds currant money of Virginia on or upon the first day of January as shall happen in every year together with the quit rents & taxes due by law for the same the first of which yearly payments of four pounds to made on or upon the first day of January in the year of our Lord One Thousand Seven Hundred and Seventy Seven if the said yearly rent of four pounds and the quit rents and taxes as aforesaid shall be behind & unpaid the space of sixty days next after the same ought of right to be paid and not sufficient or the promises to levy and pay the same by witnesses that then and from thence forth it shall may be heretofore paid the said BERTRAND EWELL & JESSE EWELL their heirs or assigns into the said demised premises to re-enter & the same to hold again as in their former & proper estate the same as though this lease had never passed anything here in contained to the contrary in any wise whatsoever. And the said JAMES PILCHER his heirs or assigns shall not suffer or commit waste on the premises during the said term nor sell any of the timber without lease obtained from the sd. BERTRAND EWELL & JESSE EWELL their heirs or assigns in writing under the for factore of this lease and further it shall & may be lawfull to & for the sd. BERTRAND EWELL & JESSE EWELL their heirs or assigns to cut up & carry of all dead & fallen down trees for the premises not wanting for the plantation use during the sd. term . Lastly the sd. BERTRAND EWELL & JESSE EWELL their heirs and assigns paying the rents as aforesaid shall and will warrant & defend the sd. lands & premises unto the sd. JAMES PILCHER his heirs and assigns during the term or lives before mentioned according to the true intent & meaning of these presents & that free & clear & freely & clearly acquitted, exonerated & discharged or otherwise by the said BERTRAND EWELL & JESSE EWELL.

Term or lives of the said JAMES PILCHER, his wife ANN and son STEPHEN PILCHER and during the term of the longest liver of them. All that tract, piece & parcel of land lying & being in Prince William County, on the Branches of the Beaver Dam run beginning on the West side of the wood cutting ground in the line of CORNELIUS KINCHELOE extending with his line to the head of a branch of the said Beaver Dam run near the old neck road & near the coal pitts burnt by STEPHEN PILCHER Senr. for GILBERT MURRAY dec’d. then down the sd. branch its several courses so far as to be in a straight line to the Corner of the wood cutting lott entending along the sd. line as far as the said JAMES PILCHER chooses & along the West side of the wood cutting by the old trees from the beginning also as far as he chooses & then by any to lines so far in the wood cutting as shall give one hundred acres of land in the whole. Together with all houses, outhouses, buildings, orchards, yards, gardens, ways & waters, water courses, profits, commodities & appurtenances whatever to the sd. tract, piece, parcel of land belonging or in any wise appertaining and the reversion & reversions, remainder & remainders, rents, issues & parcel of land belonging or in any wise appertaining and the reversion & reversions, remainder & remainders, rents, issues & profits thereof. To have and to hold the sd. piece and parcel of Land with all & singular the premises & appurtenances thereunto belonging unto the sd. JAMES PILCHER his heirs & assigns kept has inless & indomified of & from all former and other bargains, sales, leases, incumbrances & agreements whatsoever had made, done or offered to be had made or done by the sd. BERTRAND EWELL their heirs or assigns or by any other person or persons claiming by from him them or any of them. Witness whereof the sd. BERTRAND EWELL & JESSE EWELL & JAMES PILCHER this present indenture of Lease hath interchangeably set their hands & seals the day, month & year first before written.

At a court held for Prince William County the 6th day of February 1775. This Lease from BERTRAND EWELL & JESSE EWELL to JAMES PILCHER was acknowledged by the said parties & admitted to record.
