WILL OF JAMES CONGLETON, DECEASED.
Be it remembered that at a Court of Probate within and for the County of Washington and State of Ohio, holden at the Court House in the City of Mairetta, on the 2nd day of December, 1918, before the Hon. A. A. Schram, Judge of said Court, the following was entered on the Journal of said Court.

In the Matter of the Will of James Congleton, deceased.
/ Will Presented
This day came Bert Congleton and presented to Court an instrument of writing purporting to be the last will and testament of James Congleton, deceased, and made application to have the same admitted to probate. Notice issued and cause set for hearing on December 20, 1918, at 10 o'clock A. M.
Said Instrument of Writing is in the words and figures following:
THE LAST WILL AND TESTAMENT
OF
JAMES CONGLETON
of Marietta, Ohio
In the Name of the Benevolent Father of All:
I, the said James Congleton, being of sound and disposing mind and memory, considering the uncertainty of continuance in life, and desiring to make such disposition of my worldly estate as I deem best, do make, publish and declare, this to be my last will and testament; hereby revoking and annulling any and all former will or wills whatsoever by me made.
First: I desire all my just debts and funeral expenses to be paid, as soon as possible after my decease.
Second: I give and bequeath and devise to Anna J. Congleton, my beloved wife, the following described real estate for her life estate to have and to hold during her life time, to wit:-
Seventy two acres of land more or less twenty aces of which is located in Newport Township and fifty two acres in Marietta Township, Washington County, Ohio. Bounded on the North by lands owned by Caleb S. Thornley and Peter Stagner, on the West by lands owned by J. G. Cain and Samuel H. Putnam, on the South by lands owned by Joseph Lane and James Amos and on the East by lands owned by Permelia Rowland.
Third: I give and devise and bequeath to the heirs of Bernard R. Congleton deceased, namely, Barnard Congleton, Hazel Congleton, and Judson Congleton fifty dollars ($50.00) each; to the heirs of Emanuel P. Congleton, namely, Nerell Congleton, Vivian Congleton and James Congleton fifty dollars ($50.00) each; to the heir of Judson Congleton, namely Mildred Congleton ($100.00) one hundred dollars. All of the above bequests to be paid after the death of my said wife Anna J. Congleton.
Fourth: I give devise and bequeath all the rest, remainder and residue of my estate to my three children, Bertie D. Congleton, Minnie N. Sargent, and Clara Safreed, share and share alike.
Fifth: If it should become necessary in order to carry out the terms of this will to sell all or any part of my said real estate I hereby authorize my executor to sell same at the most advantageous terms possible and to make, execute and deliver good and sufficient deeds therefor to such purchaser or purchasers.
Sixth: I give and bequeath to my said wife Anna J. Congleton all of my personal property of whatsoever kind.
I nominate and appoint Bertie D. Congleton to be the executor of this Will and it is my will that he shall serve without giving bond as such executor.
In Witness Whereof, I have hereunto set my hand and seal this 23rd day of August in the year one thousand nine hundred and Twelve (1912).
