      <description>Well, I haven't concentrated on the Faggard line for some time, but add bits and pieces as I find them.  I don't know if I have anything different that you.  If you care to you can send me what you have, I'll go through it and send you anything different that I have.  I only have back to Henry Faggard born 1760 South Carolina.&lt;br&gt;&lt;br&gt;Which Henry Wells Faggard are you descended from?       <description>Are you still researching the Faggard family tree?  My Grandfather was Henry Wells Faggard, Sr.  I did a good bit of research on them but stopped several years ago and starting up again.  I have some info, but probably not much more than you.       <description>I've seen the same reference of Lucinda Faggard being married to Walter Denny.  In a 3 volume set entitled Denny Genealogy by Margaret Collins Denny Dixon and Elizabeth Chapman Denny Dunn, Walter Denny (now believed to be the son of David Denny, Jr. and Margaret Denny) was married to a Lucinda Faggart of Dutch ancestry.  One of their children was Walter Denny, Jr., born Jackson Co.., MS in 1816.  Others suggest that this is a mistake.  Walter Denny had a daughter Malinda Denny (married John Turner, son of patriot Noel Turner) born 1804 in Georgia who died in Bayou Le Batre, AL in 1891.  She was Melinda Denny Turner's mother.  I am descended from Melinda's older sister Sarah Turner.  I have other information and cousin's contacts I can share with you.  I have a photocopy of Malinda Turner's obituary from 1891. </description>

      <description>The William Faggard mentioned in the illegal cattle scam was William Fox Faggard son of John McLain Faggard and Melissa Fox Faggard.  William was first married to Edna Lenora Trail and then after their divorce he married Leota Bell Zion.  My parents said he was quite a character.  When my mother was expecting her first child, William wanted them to name the baby after him if it was a boy.  It was but they did not do that and it supposedly made him mad.  By 1920 William and Edna and family had removed themselves from Portales, New Mexico and were living in Wichita Falls, Texas.</description>

The following statement of the nature and result of the suit taken from appellant's brief we have found to be full and correct, viz.: "This suit was brought by Williamson as plaintiff against Faggard as defendant to recover damages for an alleged breach of a verbal contract entered into by the parties for the making of a crop on defendant's farm, the terms of which were, in substance, that defendant should furnish the land, and a dwelling house for plaintiff and his family, and all the seed, tools, team, and feed, and the labor of himself and nephew, and that plaintiff should move upon the farm and furnish the labor of himself and son, and the assistance of his wife, when necessary. Plaintiff was to have one-third and defendant two-thirds of the crop made, which was to be gathered jointly, except that each party was to gather his own share of the cotton crop. The foregoing comprises the contract as set out in plaintiff's petition, and so far is supported by the testimony of both parties. But on the trial of the cause it was developed that the contract embraced, besides the stipulations in regard to making a crop, an agreement for the raising of money on defendant's land, which was the original object of the contract, and according to the terms of which defendant was to convey the land to plaintiff, who was to endeavor to obtain a loan on it, and was then to reconvey it to defendant. Defendant also claimed that plaintiff agreed to furnish a horse and ox, and the labor of all his children, when needed, in the crop. Plaintiff alleged that defendant withdrew his teams, and so forced him to abandon the contract and quit the farm after he had done several months' work. Defendant testified that plaintiff, after being put in possession of the farm, refused to reconvey the land as he had agreed to do, and that this constituted the original breach of the contract. After demurrers, general and special, on both sides, had been disposed of, a trial was had before a Jury, who rendered a verdict for plaintiff for $260.28, and judgment was entered accordingly."&lt;br&gt;&lt;br&gt;We are of opinion the court below erred in sustaining appellee's exception to that part of appellant's answer pleading an arbitration and award as to the matters in controversy since the institution of the suit. It seems the court held the agreement for the arbitration to be invalid under rule 47 for the government of the district courts, because not in writing. This rule reads: "No agreement between attorneys or parties touching any suit pending will be enforced, unless it be in writing, signed and filed with the papers as part of the record, or unless it be made in open court and entered of record." In Wells v. Lane, 15 Wend. 99, a similar rule was held not to prohibit an oral agreement to arbitrate a pending suit. We believe the uniform construction placed upon this rule by the profession has been that it applies to proceedings in the conduct of the case in court, and does not prohibit oral agreements for the settlement of the matters in controversy outside of the suit. The construction contended for by appellee would prohibit even evidence of payment unless a written receipt be taken and filed in compliance with the rule. The tendency of our supreme court has been to construe this rule to be directory, rather than mandatory. Williams v. Huling, 43 Tex. 113; Capt v. Stubbs. 68 Tex. 225, 4 S. W. Rep. 407; Jenkins v. Adams, 71 Tex. 1, 8 S. W. Rep. 003; Kohn v. Washer, 69 Tex. 67, 6 S. W. Rep. 551.&lt;br&gt;&lt;br&gt;That a common-law arbitration is binding in this state does not seem to be denied. Myers v. Easterwood, GO Tex. 107. In fact, our statute expressly provides that "nothing here-in shall be construed as affecting the existing right of parties to arbitrate their différences in such other mode as they may select. 1 Snyles' Civil St. art. 56. Neither can it be questioned but that this right extends to pending suits. Myers v. Easterwood, supra. That an oral submission to arbitration, when not in conflict with statute of frauds, is binding at common law cannot be controverted. Morse, Arb. 50; 1 Amer. &amp;amp; Eng. Ene.&lt;br&gt;Law, 055. That part of the contract by which appellee agreed to convey to appellant the land conveyed to him for the purpose of effecting a loan upon it, not having been pleaded by either of the parties, was&lt;br&gt;correctly ignored by the court. The other assignments relate to errors that will probably not occur upon another trial, and will therefore not be considered. The judgment of the court below Is reversed, and the cause remanded.&lt;br&gt;&lt;br&gt;</description>

Appellee was Indicted in the district court of Eddy county for obtaining money by false pretenses under section 1551, Code 1915. The court sustained a demurrer to the indictment, and the state appealed.&lt;br&gt;&lt;br&gt;The indictment is very lengthy, and It would unduly lengthen the opinion to set it out. It set up in great detail the fact that appellee had entered into an arrangement with the St Joseph Cattle Loan Company, a corporation of St. Joseph, Mo., by which appellee was to purchase cattle in Eddy county, N. M . and was to mortgage the cattle to the corporation named, and was to draw on the corporation for the money necessary to finance the purchase, attaching to the draft the bill of sale to appellee for the cattle, the mortgage on the cattle executed by appellee to the corporation, and a promissory note for a like amount secured by the mortgage. The indictment alleged that appellee entered into an arrangement with one D. W. Smoot, as a dummy, by which Smoot was to execute to appellee a bill of sale for 126 head of cattle, Smoot owning no cattle, and that appellee prepared and executed a chattel mortgage on the same fictitious cuttle and a note, and then proceeds:&lt;br&gt;&lt;br&gt;"The said William Faggard, on the 15th day of October, in the year 1017, at the county of Eddy and in the state of New Mexico, unlawfully, feloniously, and designedly devising to cheat and defraud St. Joseph Cattle Ix&amp;gt;an Company, a corporation aforesaid, did then and there unlawfully, falsely, designedly, and feloniously pretend to St. Joseph Cattle Loan Company, a corporation aforesaid, by virtue of one false and bogus bill of sale, signed and executed by D. W. Smoot as aforesaid, and delivered to William Faggard, as aforesaid, pretending to transfer title and ownership to 126 head of two year old steers from D. W. Smoot to William Faggard as aforesaid, together with a&lt;br&gt;&lt;br&gt;false and bogus draft in the amount of $5,670, drawn by D. W. Smoot aforesaid on St Joseph Cattle Loan Company, a corporation, aforesaid, and attached to the said false and bogus bill of sale aforesaid ; that he, the said William Fag- gard, was the owner of and in the possession of the said 126 head of two year old steers aforesaid, and the said William Faggard did then and there execute in favor of and deliver to St. Joseph Cattle Loan Company, a corporation aforesaid, a certain false and bogus chattel mortgage on said 126 head of two year old steers aforesaid, by means of which false pretenses and false and bogus bill of sale and draft attached thereto as aforesaid, and drawn on St. Joseph Cattle Loan Company, a corporation as aforesaid, at and through the State National Bank of Carlsbad, a corporation, and together and by means of said false and bogus chattel mortgage as aforesaid, he, the said William Faggard, did then and there unlawfully, falsely, fraudulently, designedly, feloniously, and with intent then and there to cheat and defraud the St. Joseph Cattle Loan Company, a corporation, the said William Faggard caused the said draft in the sum of $5,670 to be drawn as aforesaid, and the said sum of $5,670 to be deposited in the name of D. W. Smoot aforesaid, to the account of D. W. Smoot aforesaid with the State National Bank of Carlsbad, a corporation, and thereafter he, the said William Faggard, devising to cheat and defraud as aforesaid, feloniously, unlawfully, designedly, and fraudulently procured the said D. W. Smoot aforesaid to sign his name to certain blank checks given on the State National Bank of Carlsbad, a corporation aforesaid, and by reason of said blank checks, signed in blank by D. W. Smoot as aforesaid, the said William Faggard, by himself and through his agents and instrumentality, did obtain from the said St. Joseph Cattle Loan Company, a corporation, of the goods, chattels, moneys, and property of the said St. Joseph Cattle Txjan Company, a corporation, the sum of $5,670, lawful money of the United States of America."&lt;br&gt;&lt;br&gt;The demurrer to the Indictment contained several grounds, the first being that, if any offense of obtaining money for false pretenses had been committed, the same was committed at St. Joseph, in the state of Missouri, and not within the state of New Mexico, and that the district court of Eddy county had no jurisdiction to try it. Another ground was that the Indictment failed to allege the essential elements of the crime attempted to be charged with such a degree of certainty that the defendant might be apprised of that with which he was charged, and that beginning nt line 18 of the second page of said indictment it is charged that the defendant caused a draft to be drawn on the St. Joseph Cattle Loan Company, and caused a certain sum of money to be deposited in the name of one Smoot; but it nowhere appears by whom such deposit was made, nur is it alleged In said indictment that the person, flrm, or corporation had received any communication of a bogus draft or bill of sale, or any other false pretense, and thereby relied upon the same In parting with the money so deposited, all of which said allegations are essential to a valid indictment. The court sustained the demurrer generally, but In this court both appellant and appellee assumed that the demurrer was sustained because the indictment failed to show that the venue was In Eddy county, and this Is the only question argued in either brief.&lt;br&gt;&lt;br&gt;[1] Both parties concede that the venue of the crime depended upon where the defrauded party parted with his money. In other words, if the St. Joseph Cattle Loan Company parted with Its money in Eddy county, then the venue was properly laid In that county; on the other hand, if the money was parted with in St. Joseph, Mo., then the venue was there. The law is that a crime must be prosecuted in the Jurisdiction where it is committed, and a prosecution for criminal false pretenses must be had in the county, district, or state where the offense was consummated by the obtaining of the property, even though the inducing pretenses were made elsewhere, and the OHeummation by delivery of the property was effected through the instrumentality of an innocent agent, without the personal presence of the principal. 11 R. C. L. p. 854.&lt;br&gt;&lt;br&gt;[2] Appellee argues that the indictment shows that the money was obtained by means of a draft drawn on the St. Joseph Cattle Loan Company, and necessarily It would be raid at St. Joseph, Mo. The state contends that the indictment does not show that the draft was ever sent through to St. Joseph, Mo., and there paid; T:hat so far as appears on the face of the indictment the corporation might have parted with Its money in Eddy county ; that it may have had an agent In that county, who took up the draft at the local bank. We are inclined to agree with the state in this contention, but the indictment is fatally defective for another reason, and therefore we are compelled to hold that the court properly sustained the demurrer.&lt;br&gt;&lt;br&gt;The defect in the Indictment exists by reason of the failure of the state to allege and show that the money deposited in the bank at Carlsbad was the money or property of the St. Joseph Cattle Loan Company, alleged to have been defrauded. The indictment, after showing the false pretenses and the drawing of the draft, says:&lt;br&gt;&lt;br&gt;"The said William Faggard caused the said draft in the sum of $5,670 to be drawn aa aforesaid, and the said sum of $5,670 to be deposited in the name oí D. W. Smoot aforesaid, to the account of D. W. Smoot aforesaid, with the State National Bank of Carlsbad."&lt;br&gt;&lt;br&gt;But It fails to allege that the money so deposited was the property or money of the St. Joseph Cattle T.oan Company. So far as appears, Faggard himself might have deposited&lt;br&gt;&lt;br&gt;the money, or It might have been deposited to Smoot's credit by the State National Bank of Carlsbad. In the Indictment it Is alleged that Faggard induced Smoot to sign checks in blank, and that he filled out such checks for the amount of money theretofore alleged to have been deposited to Smoot's credit in the bank, and cashed the checks and obtained the money so deposited, and that by so doing, "by himself and through his agents and instrumentality, did obtain from tke said St. Joseph Cattle Loan Company," etc.,/'the sura of $5,670." The Indictment wholly fails to show the connection between the false pretenses, the drawing of the draft, the deposit of the money In the Carlsbad Bank, the obtaining of the same by Faggard, and the defrauding thereby of the St. Joseph Cattle Loan Company.&lt;br&gt;&lt;br&gt;[3] Where we should have light upon an essential fact, 1. e., the ownership of the money deposited in the bank at Carlsbad to the credit of Smoot, the Indictment is silent. So far as appears In the indictment before us, the draft may never have been delivered to or accepted by the injured party. In the case of Lutton v. State, 14 Tex. App. 518, it was held that the failure to allege, in an indictment for swindling by means of a bogus draft, that the draft was delivered to or ac- cepteVl by the Injured party as the consideration upon which the money was advanced, vitiated the indictment. The majority rule in the United States is to the effect that, in the absence of statute, an indictment for obtaining property by false pretenses must allege, directly and distinctly, the ownership of the property obtained; and the territorial Supreme Court, In the case of Territory v. Hubbell, 13 N. M. 579, 86 Рас. 747, 13 Ann. Cas. 848, adopted this rule. Many cases will be found cited in the note to this case. Unless the money deposited in the Carlsbad bank was the money or property of the St. Joseph Cattle Loan Company, the company could not have been defrauded by Smoot signing the blank checks, by means oí which appellee obtained the money from the Carlsbad bank; and unless it was the money of the cattle company, there would be no connection between the false pretenses and the procuring of the money on the checks in question. Had the Indictment set forth the facts as to the securing of the money from the St. Joseph Cattle Loan Company on the drafts, It would have shown upon its face whether the money was parted with by the company at St. Joseph, Mo., or in Eddy county, M. M. ; but it wholly fails to show that the St. Joseph Cattle Loan Company ever parted with any of the money upon the draft.&lt;br&gt;&lt;br&gt;For the reasons stated, the judgment will be affirmed ; and It is so ordered.&lt;br&gt;&lt;br&gt;HANNA, O. J., and PARKER, J., concur.</description>

      <description>Hi Dan, Several years ago I sent you my Faggard family research which you incorporated into your family tree but where I stopped at George Washington Faggard you show him as the son of Daniel Faggard.  Have you found a source that places George in Daniel's family?  I would love to know as I haven't been able to find anything that points to George being the son of Daniel other than living in Alabama.  Please let me know what you have found, I would love to add it to my research&lt;br&gt;Thanks&lt;br&gt;Susan Reedy</description>

      <description>Hi Dan,&lt;br&gt;&lt;br&gt;I haven't done any research on Henry for a long time.  Some think the Faggard/Faggart families in North Carolina are related to ours.  I'll have to check that out.  Sorry to say I don't have any information on your Thomas O'Caine. My grandparents had 2 sons Alfred who was adopted and my father Rodney.I have always tried to find where my line came from but could not get to far. I was told that the name Doyal was changed from Doyle because my grandfather and his brother had a fight over business? I realy dont know that much more about the background if you can clue me in alittle bit i would appreciate it. My father was married to my mother Ruth Kallmeyer and had two boys me and my brother Steven who passed away when he was young because he had his stomach removed because of an infection. Also Lee had two daughters one Joyce and the other Thelma Scott was her married name.</description>

I believe here father was George--because my gm daid her fathers name was George, because Susan is in the 1880 Hamilton cty Tx census next to Martha, the widow of George, and because John Faggar, son of George, was guardian of her children after her death. She died young, as did her daughter, my ggm Hattie Deaton, and so some family connctions were lost. I could be wrong about George being her father, but everything points in that direction. I cant find George in 1860 census, but I do have land records where he bought land in 1860 in Hamilton cty. He is on 1870 Hamilton cty census, but Susan was married to James Deaton by then.</description>

      <description>I found your posting while researching my wife's Graham family history. Joseph Graham, father of Susannah Graham, was a nephew of my wife's gg-grandfather, Laird Graham. Joseph Graham was a son of William Graham, brother to Laird. Also, I noticed that you had placed posts about the surname Hollingsworth.&lt;br&gt;Valeda (sp?) Graham married William Hollingsworth; granddaughter of Joseph Graham, a third brother. I will be glad to trade information with you concerning the Jackson County Grahams.       <description>Hi Charlie,&lt;br&gt;&lt;br&gt;Glad you responded!  My great-grandmother, Debrillia Leuticia Faggard was born in Hico, Texas in 1871.  Her parents were John McLain Faggard and Malissa Jane Fox.  John was the son of George Washington Faggard born abt 1823 in South Carolina.  George migrated to Alabama, probably with his parents.  They were in the Mobile area.   His son, John McLain was born in Choctaw Co., AL in 1849.  His father, George, had migrated north from Mobile Co.  Then they all ended up in Texas.&lt;br&gt;&lt;br&gt;We are trying to prove the parents of George.  I have two Warrens in my database.  Do you have his birthdate, or know his father's name?  How far back can you go?  I'll be glad to help you!</description>

We Faggard researchers only have two &lt;br&gt;sons, Daniel b abt 1784 SC and John G. b abt 1802 SC, so&lt;br&gt;your Lucinda would fit in this family. John G. married&lt;br&gt;Lucinda Denny. My line, George Washington Faggard, is so&lt;br&gt;far not connected to parents. There was a Samuel Faggard&lt;br&gt;in Mobile Co., AL the same time as Daniel and Henry, but I&lt;br&gt;can't find information on his children.
