LAST WILL AND TESTAMENT
I, JOHN A. MANN, of TOLEDO, LUCAS COUNTY, OHIO, being of full age and of sound mind and memory, do make, publish and declare this to be my last will and testament, hereby revoke all wills by me heretofore made.
ITEM 1: I direct that all my just debts and funeral expenses be paid out of my estate as soon a practicable after the time of my decease.
ITEM II: I give and bequeath to Lutheran Welfare Service of Northwestern, OHIO, the sum of One hundred fifty and no one-hundredths ($150.00) dollars.
ITEM III: I give and bequeath to St. John’s Evangelical Lutheran Church, 708 South Erie Street, TOLEDO, OHIO, the sum of One hundred fifty and no one-hundredths ($150.00) dollars.
ITEM IV: I give and bequeath to The Lutheran Orphan’s and Old Folk’s Home of the City of TOLEDO, OHIO the sum of one-hundredths ($150.00) dollars.
ITEM V: After the payment of just debts and funeral expenses mentioned in Item 1 and the payment of the bequests named in Items II, III, IV, I gave, devise and bequeath all the rest, residue and remainder of my property to, real and personal, which I may own or have the right to dispose of at the time of my decease, to my daughters, Florence Hichener and Vivian M. Mann in trust, however, for the uses and purposes and for the benefit of the persons hereinafter named, to wit:
During the life of my wife, Anna Mann, they shall use said property, both principal and interest, for the support and maintenance of my said wife.
After the death of my wife, Anna Mann, said trustees shall pay the costs of her last sickness and funeral (but not any debts which she may have contracted).
Out of the money then remaining said trustees shall pay to my daughter Jeanette Keller, the sum of One Thousand ($1,000.00) Dollars.
The balance of the money then remaining in said trust shall be distributed as follows:
One-fourth (1/4) thereof to my daughter, Jeanette Keller:
One-fourth (1/4) thereof to my daughter, Florence Hichener
One-fourth (1/4) thereof to my daughter, Vivian M. Mann
One-fourth (1/4) thereof to my son Lloyd, and his wife Vivian H. Mann
ITEM VI: I make, nominate and appoint Florence Hichener and Vivian M. Mann to be executrixes of my state, and (Jeanette B. Keller & Vivian M. Hambleton) empower my said executrixes and my said trustees to compound, compromise, settle and adjust all claims and demands in favor of or against my estate or the trust herein established, and to sell, at private or public sale, at such prices and upon such terms of credit as they may deam best, the whole or any part of my real or personal estate, and to execute, acknowledge and deliver deeds and proper instruments for the conveyance thereof to the purchaser or purchasers, and my said trustees, or either of them. Shall have the full power to hold and control my real estate, rent the same, to maintain said real estate, to invest and re-invest, the principal, interest and income from the management of said trust, and to do and perform any and all other sets in the management of said trust, and to do and perform any and all other sets in the management of said estate and trust as I might do, if alive and personally present.
If either of the trustees or executrixes herein appointed shall fail or neglect to act, then the other trustee or executrixes may assume all control and shall have all the powers herein granted.
ITEM VII: I request my executrixes to employ Norman E. Bischoff as attorney to assist and aid them in the administration of my estate.
