I was researching some of the Box's that came to Tx.(1830-1850's) that were born in or around Laurens Co. and found this will on the net. Thought it might be of interest to Box/ Hudgens researchers.

Appears to be quite a bit of information for the Hudgens family in particular.

Does anyone know which Josiah Box who apparently was married to Polly Hudgens in Laurens Co. who he belongs to???? Looks like the will was written in 1860. (Looks like they may have had children Fannie Moore and Etta Jerry when will was administered.


The will of William Henry Hudgens is recorded in Laurens County, South Carolina, Box 147, pkg 16.

I William Hudgins Sr. of the state and district aforesaid do make this my last will and testament so follows. First - I give to my wife Frances my homestead tract of land with the improvements and forces of five negroes such as she may choose to keep with stock of all kinds so much as she may think proper to keep as much household & kitchen furniture as she chooses to keep, plantation tools, wagon & harness (?) and provisions to support her and her stock until she has time to make a (?) all the above property. I give to my said wife during her life and at her death to be sold by my Executors herein after named and divided according to the manner that I direct the balance of my estate to be divided with same trusts and limitations. I give to my grand daughter Catherine Allison five hundred dollars. I give to my grand daughter Mary the wife of Nathan Barksdale one thousand dollars. All the balance of my estate real and personal I direct shall be sold and after paying my last debts and funeral expenses and the legacies above stated shall be divided following one share to my son James upon his accounting for one thousand dollars heretofore advanced to him in land & money. One share to my son John upon his acounting for six hundred dollars advanced to him in land. One share to my son William upon his accounting for six hundred dollars advnced to him in land. One share to my son Henry upon his accounting for six hundred dollars advanced to him in negro property. One share to my son John in trust for the use of my daughter Nancy the wife of Lewis Allison during her life and at her death equally amongst her children. One other share to my son John in trust for the use of my daughter Polly the wife of Josiah Box during life and at her death equally between her children but should she die without having a child or children or should she leave a child & that child die unnamed and without having a child the share so willed shall revert back and be divided amongst my other children equally. One share I give to my son John in trust for the use of my daughter Elizabeth the wife of John Boyd during her life and at her death equally amongst her children and one other share I give to my said son John in trust for the use of my daughter Sally the wife of James Downey during her life and at her death equally between her children, all the aforesaid trust estates I allow the trustee to invest in property for the use of his sisters as they may desire & at any time to sell and reinvest as they may desire as I wish them to have the use of said property or money but the title to be and remain in the trust of the property willed to my wife during her life is to pay to my four sons & to this trustee for my four daughters the thousand dollars willed to my grand daughter Mary Barksdale her full share of my estate. Lastly I appoint my two sons James & John Hudgins my Executors to this my last will this 13th July 1860. Witness my hand & seal in presence of

Petition For settlement of Estate

The petition of the above named petitioners respectfully shows to the Court

1. That William Hudgens died on the day of 18 testate having appointed your petitioners as the Executors of his last will and testament

2. That your petitioners on the day of 18 qualified as Executors and took upon themselves the execution of the trust.

3. That they have fully administered the estate of the said William Hudgens and now desire to settle the same, and to receive their discharge as Executors.

4. That the following named persons are desirus and legatees under the will of William Hudgens to wit your Petitioners: Henry Hudgens, J. B. Hudgens, Trustee, Nancy Allison, Mary Frances Culbertson, Susan Knight, Elizabeth Jane Allison, Parthenia C. Caldwell, Nancy Allison, H. R. Allison, J. H. Allison, Catherine McClellan, Isabella Avery, Sarah Catherine Taylor; the children of William Hudgens to wit, W. H. Hudgens, Frances Devlin, Sallie Campbell, Annie Hudgens, Jackie Hudgens, James Hudgens; the wife and children of Albert Hudgens names and ages unknown; the children of Elizababeth Boyd to wit, Mary Boyd, James Boyd, Richard Boyd, Adison Boyd and Henry Boyd; the children of Polly Box to wit, Fannie Moore and Etta Jerry; the children of Sallie Downey to wit, Emma L. Downey, Lidie H. Downey, James H. Downey and Lillie F Downey, the last named two of whom are minors.

That of the above named D(?) and Legatees, the following are non residents of the State. Sarah Catherine Taylor, Isabella Avery & Richard Boyd residing in Arkansas - Henry Hudgens residing in Florida, W. H. Hudgens, Francis Devlin, Lillie Campbell, Annie Hudgens & Jackie Hudgens residing in Tenn - James Hudgens residing in Texas, and the wife and children of Albert Hudgens, names and residence unknown.

Wherefore your petitioners pray that this court may take the necessary steps for the settlement of the estate and for final discharge of your petitioners as Executors of William Hudgens decd, and to this end that the (?) and legatees be summoned to show cause before this court on a day certain why the relief asked for should not be granted, and that an order for publication against the absent (?) and legatees be (?) by this court and that g(?)----- be appointed to represent the minor (?) and legatees upon the settlement.
