Petition of Henry FLANNERY, guardian of the persons and estates of James KERST,
Hannah KERST, and Emma KERST, and of Herman UMSTEAD, guardian of the persons
and estates of John KERST and Cherington KERST, all minor children of Harrison
KERST, late of Union Twp., in the county of Berks.
Respectfully respresents:
That Harrison KERST late of the said township of Union in the said county of
Berks, deceased, died intestate in the year AD 1849 leaving a widow named
Matilda KERST and issue 5 children to wit: James KERST, Hannah KERST, and Emma
KERST who have Henry FLANNERY above named for their guardian, and the said John
KERST and Cherington KERST who have the said Herman UMSTEAD for their guardian;
that the said Harrison KERST at the time of his death was seized in the Village
of Springfield, in the township of West Nantmeal, in the county of Chester
adjoining lands of Peter HARDWARK and others and containing 3 acres more or
less with the appurtenances; which said lot of land with the messuage thereon
erected has by virtue of the laws relating to the descent and distribution of
intestate's estate descended and come to the said 5 children of the said
Harrison KERST in fee subject nevertheless to the interest of Matilda as widow
of the said intestate, in the same: that the said minors have always resided
in the said county of Berks and still continue to reside therein, that the said
messuage and lot above described yield but very little profit to the said
monirs, as they yearly require considerable sum of money to keep them in
repair, that the whole estate of the said minors besides the said real estate
is but about two thousand dollars in personalty, the interest of which is
entirely insufficient for their support and education, and that it would be
most eligible that the said messuage and lot of land should be sold in order to
afford additional means for the use of the said minors, it being greatly to the
interest of said minors that such sale shall be made.
Your petitioners there may the court to grant them an order authorizing them to
sell the said messuage and lot of land.

on the 27th day of Oct AD 1851, before the Honourable Henry Chapman, president
and his associate Judges present:
In the matter of an application to sell the interest of the minor children of
Harrison KERST in certain real estate and now to wit Nov 1st 1851. Upon the
petition of Henry Flannery guardian of the persons and estates of James Kerst,
Hannah Kerst, and Emma Kerst, and of Herman Umstead guardian of the persons and
estates of John Kerst and Cherington Kerst, minor children of Harrison Kerst
late of Union township in the County of Berks, dec'd, stating that the minors
by virtue of the laws relating to the descent and distribution of intestates'
estates, are entitled to the following described piece of real estate, viz: A
certain messuage and lot of land in the village of Springfield in the township
of West Nantmeal, in the county of Chester, adjoining lands of Peter Hardwark
and others containing 3 acres more or less with the appurtenances, and it
appearing to the Court that it will be in the best interests of the said minors
that the said messuage and lot of land shall be sold. The court order and
decree that an order issue to the said Henry Flanery and Herman Umstead,
guardians as aforesaid of the said minors, authorizing them to sell all the
right, title and interest of the said minors in the said messuage and lot of
land with the appurtenances upon the premises, and that the said guardians,
prior to the confirmation of the said sale shall file in the Office of the
Clerk of the said Court, a bond with two or more sureties to be approved of by
the COurt in double the amount of the proceeds of such sale, conditioned for
the faithful appropriations of said proceeds, same day John Umstead and William
Jefferis approved as sureties. Due notice to be given according to law.

That pursuant to the written order having given due notice of the time and
place of sale according to the act of assemble in such case provided, they
exposed the within described premises to sale by public vendue or outcry and on
the 15th day of December last, sold the same to Charles RETTEW for the sum of
$810 ($540 thereof payable on the confirmation of the sale and the further sum
of $270 on the decease of Matilda Kerst, the mother of the said minors) he the
said Charles Rettew being the highest and best bidder and that the highest
price bidden for the sme which sale so made, they pray may be confirmed by the
court.
