(Ref. 1)&lt;br&gt;It seems that the decree of the Orphans' Court for the sale of lands, made at the instance of the vendee's children, is admissible on behalf of those claiming adversely to the vendor and vendee, to corroborate the declaration of the vendor that he had sold to the vendee.&lt;br&gt;&lt;br&gt;     EJECTMENT by George I. Hutchinson and others, in the Court of Common Pleas of Westmoreland county, against McPeake and others.  On the trial in the court below, the question was, whether George I. Hutchinson, the father of the plaintiffs, and through whom they claimed title, or his daughter, Sarah Hutchinson, now Sarah McPeake, the wife of McPeake, one of the defendants, was the owner of the warrant under which both parties claimed the land in controversy.   The warrant was taken out in the name of Sarah Hutchinson; and to prove that it was for her use, the defendants gave in evidence, the payment of taxes, and of part of the purchase-money, by Sarah McPeake, before her marriage, and also conversations of George I. Hutchinson, in which he declared that his daughter never was a trustee for him, but was the original owner of the land, and that he had taken out the warrant in her name, because it was paid for with the money of her mother.  The plaintiffs then offered evidence of the other declarations of George I. Hutchinson, the *father, [*296 made in other conversations, denying that his daughter Sarah had any interest in the land; and asserting that the warrant was taken out for his own use.  This evidence was objected by the defendants, but admitted by the court, and an exception taken by the defendants.&lt;br&gt;     The defendants, after proving by one Harbeson, the declaration of George I. Hutchinson, the father, that prior to the date of the warrant, he had sold his improvement right in the land to one Campbell, in order to corroborate that proof, offered the proceedings of the Orphans' Court of Bedford county, under whose decree, founded upon the petition of one of Campbell's children, the land was sold.  This evidence was objected to by the plaintiffs, and overruled by the court, and an exception taken by the defendants.&lt;br&gt;     Foster, for the plaintiffs in error.-1.  It was improper to receive in evidence the declarations of George I. Hutchinson in his own favor, at times referred to in the defendants' evidence.  A party cannot explain his own confessions, by declarations made on other occasions and at other times.&lt;br&gt;     2.  The decree of the Orphans' Court ought to have been received, in corroboration of Harbeson's evidence.  It was material to show, that after a sale to Campbell, Hutchinson would not be likely to take out a warrant for himself, though he would secure it for his daughter.  He cited 4 Johns. 234; 5 Id. 426; 6 Id 21: 7 Id. 96; 2 Sm. Laws 231, 257.&lt;br&gt;     Reed, contra.-1.  Reputation of the country is evidence on either side.  To show the foundation of that reputation, the defendants gave in evidence, the declaration of George I. Hutchinson.  May not the plaintiffs also show the reputation of the country, and its foundation, so far as it operates favorably to them?  In 1 Johns. 163, it is held, that declarations, on the premises, are evidence to show the nature of the tenure.&lt;br&gt;     2.  The proceedings of the Orphans' Court were out of place:  it was setting up at title in a third person; a distinct and separate matter.   A conveyance by Campbell might have been shown.&lt;br&gt;&lt;br&gt;     *  Tilghman, C.J., was sick and absent. [*297&lt;br&gt;&lt;br&gt;     The opinion of the court was delivered by&lt;br&gt;     GIBSON, J. - The question before the jury was, whether George I. Hutchinson, the father of the plaintiffs below, and through whom they claim title, or his daughter, Sarah Hutchinson, now Sarah McPeake, the wife of one of the defendants, was the original owner of the warrant which is the foundation of the claim on both sides.  To show it was taken out, not only in the name, but for the use of the daughter, the defendants below gave in evidence various acts done by Sarah McPeake, before her marriage; such as the paying of taxes and part of the purchase-money; and then gave evidence of various conversations of George I. Hutchinson, the father, in which he declared, that his daughter never was a trustee for his use, but the original owner of the land, and that the warrant was taken out in her name, with money that came on the part of her mother.  To counteract this, the plaintiffs then offered evidence of the other declarations of George I. Hutchinson, made during other conversations than those given in evidence by the defendants, by which he denied that his daughter had any interest in the land, and asserted that the defendants excepted; and the court, thinking the evidence admissible, sealed a bill of exceptions.&lt;br&gt;     It is a clear and unalterable rule, that the declaration of parties or privies, are not evidence to support the title under which they claim.  Here, the declarations offered by the plaintiffs, were distinct, and in every point of view, unconnected with those given in evidence by the defendants; they were therefore not admissible as being explanatory, and for the purpose of laying before the jury the whole of each conversation relied on by the defendants.  It is not pretended, that everything that was said on these occasions had not been detailed by the defendants' witnesses.  But the evidence is said to competent on other grounds.  As the defendants had given in evidence, the common reputation of the country in favor of the daughter's ownership, founded, it said on the declarations of the father: and as the plaintiffs have a right to give evidence of a contrary reputation, they too, it is said, may trace it to its source and show it to have been founded on the assertions of the father. *298]&lt;br&gt;     This is strange *reasoning.  The reputation of the country and declarations of a party, are very different things.  Such declarations cannot be rendered competent, by insisting that they ought not to be called declarations, but something else.  Nor was the evidence, by showing they were made with special view, inconsistent with the truth, and persisted in, only when some charge, such as for taxes, was made against George I. Hutchinson, on the ground of his reputed ownership.  If that was the truth of the case, it was susceptible of other proof than the party's own declarations; which were no further evidence, is not more tenable.  The foundation of the argument does not, in fact, appear in the bill of exceptions; but even if it did, the result would not be different.  A naked declaration, which refers to no act done, is not rendered competent by being merely made on the land:  but a declaration explaining an act done at the time, such as an entry on the land, is competent; because the acts of a party in prosecution of his title, being competent evidence, all explanatory declarations then made, being part of the acts themselves, are also competent:  but as the acts of the party, rather than as his declarations.  Here, the declarations proposed by the plaintiffs, referred to nothing of the kind, and were therefore improperly admitted.&lt;br&gt;     The defendants having proved the declaration of George I. Hutchinson that, prior to the date of the warrant, he had sold his improvement-right to the land in question to one Campbell, offered in evidence, the proceedings of the Orphans' Court of Bedford county, under whose decree, founded on the petition of one of the Campbell's children, the land was sold.  This was offered to corroborate the declaration of George I. Hutchinson, that he had sold to Campbell; but being objected to, it was overruled.  It is not necessary to determine, what effect the evidence ought to produce, if it were admitted; it might perhaps serve to explain the reason of George I. Hutchinson's having taken the course he did, when he took out the warrant.  The question is, whether the proceedings of the Orphans' Court were admissible to corroborate the declaration of George I. Hutchinson.  At this period, improvement-rights were generally considered to be *chattel interests, and passing by parol sales of them, might be proved by parol.  The posse- [*299 sion or acts of ownership of George I. Hutchinson himself, would clearly be evidence to corroborate George I. Hutchinson's declaration, that he had sold to him: it would therefore seem, the acts of Campbell's heirs (whom the law puts in his stead), together with the proceedings of a court of competent.  Without, then dwelling on this point, which does not seem to be of much consequence to the event of the controversy, it is sufficient to say, we incline to think the evidence ought to have been admitted.       <description>I don't have much info for you. I did find in my research that John McPeck married Lydia Ann Baker in Rock Island, Illinois on March 13, 1859. I don't know if this is the correct John McPeck. You might check with the Rock Island court house for info on this marriage.&lt;br&gt; According to my info John came from Missouri and fought in the Civil War on the Confederate side. Although he was born in OH. I got this info from my uncle who is the G Grandson of John McPeck.&lt;br&gt;&lt;br&gt;I am decended from Rosa McPeck. I have info on her decendents. Rosa McPeck was born Aug 9, 1867 and was the twin of Rhoda McPeck. She married William H. Phillips b. May 28, 1863. They had five children Celia Eunice Phillips, Jesse Mae Phillips, John Henry Phillips, Harold William Phillips and Clifford John Phillips. Rosa died June 3, 1959 and is buried in Barry Co. MI</description>

      <description>Your and my John Peck did not fight in the Civil War. That was John E Peck and he was the son of Johns brother whos bio is posted at the county site.  They were both from Harrison County Ohio which makes it quite confusing. They were both born c1832.</description>
