      <description>I don't agree. Luke II had two sons, Luke III who shared his inheritance with his mother, Elizabeth (Mariott), who then married Robert Hill. See administration of his estate by Elizabeth and Robert Hill. There are several references on this as they did not report the inventory when it was due, At that time the rule of primogenitor was still the law and the heir did not have be mentioned in a will. I believe Luke II also had a son, William, who may have been born after his father's death, William and Luke III moved to Bertie County and William soon moved across the Roanoke River to Tyrell County, in the portion that later became part of Martin County. </description>

      <description>My name is Shannon Means. I am looking for my dads paternal line. I have it as far as Thomas M. Mysell and I lose it.  He was married to Mary T(?)Smith Browning and I believe he raised her 4 Browning sons also. Another problem is that when my dad was 2 years old his biological father (Ovie Mysell, son of Hardy Mysell) died and he was raised in the name of his step father Cecil Patton. My dads name is Melvin Noal Patton and his full brothers name is Elton Theodore Patton. There was never any formal adoption. Any help would be appreciated. My dad does remember his Grandma Mary (wife of Hardy) who was a very devout religious woman who lived in La. He said she had about 10 middle names and was very strict! My dads mother was Wilda Kennedy from Sugartown, La. My dad was born and raised in Merryville, La. for a time, until he moved to Conroe, Tx.</description>

      <description>Recently using Google Books and searching for Luke Mizell +Susannah Charlton`I found information in the North Carolina Historical and Genealogical Register, Volume I, page 87. Covered on that page: October 10, 1702. Test, Susanna Charlton and Mesell (Mizell.&lt;br&gt;&lt;br&gt;I have an affadavit found for me by William Bennett, in which Luke II testified that he was married in 1703.This is not proof of their marriage but shows the two were connected prior to his marriage.&lt;br&gt;&lt;br&gt;William Bennett also told me that he had never seen a document proving the two were married, but this is as close as we are probably going to find.</description>

      <description>Hi, in the year 2000 we did a lot of work on the Swain/Smithwick connection.  We had Mary Swain [in error]as the wife of Samuel Smithwick, the father of Sarah Smithwick&lt;br&gt;who is the wife of Luke Mizell IV.  We learned that Mary Warren is the wife of Samuel Smithwick &amp;amp; parents of Sarah Smithwick who married Luke Mizell IV.&lt;br&gt;&lt;br&gt;I notice you have Sarah Speller as the wife of your ancestor&lt;br&gt;John Smithwick.  This is probably from the book HUGH SMITHWICK DESCENDANTS. Carl E. Swain of Claxton, Georgia&lt;br&gt;has some excellent work that proved to me that Mary Swain [see above]was the wife of John Smithwick; not Sarah Speller.  I recall from memory only that this was confirmed&lt;br&gt;with William Bennett who did a lot of the research on the book HUGH SMITHWICK DESCENDANTS. If you are interested I can send you a copy of my email from Carl E. Swain documenting that Mary Swain is the wife of John Smithwick.&lt;br&gt;Don Dunnington</description>

      <description>I agree that John is the son of Lawrence, whose estate was settled in 1698, sometimes this was several years after the person's death. John's only sibling that I have found is "Elinor".&lt;br&gt;&lt;br&gt;In:Probate Records in Chowan County N.C. Bound Miscellaneous Papers, 1694-1799. compiled by Jonathan B. Butcher,published in The North Carolina Genealogical Society Journal, August 1981.&lt;br&gt;&lt;br&gt;On April 1747 Margaret petitioned for adm on her husband, John Meazel.&lt;br&gt;&lt;br&gt;In 1748 Divission to:the widow, John Meassells, Joseph Meassells, Moses Meassells, Aaron Meassells, Timothy Meassells, Jeremiah Meassells and Margaret Meassells.&lt;br&gt;&lt;br&gt;I have made numerous trips to the North Carolina Archives and have information from original documents, deeds, wills and court records. and books compiled by different authors.&lt;br&gt;&lt;br&gt;Most large libraries have good genealogical records and there are many from North Carolina. You cdeeds, wills and court records.an also search Google Books and find some information.&lt;br&gt;&lt;br&gt;Hope this information will be of help.&lt;br&gt;&lt;br&gt;Barbara</description>

      <description>I am working on my family beginning with Aaron Mizell (1730-ca. 1809).  I believe this Aaron is the son of John Mizelle (1712-1747) and Margaret Miller (1710-1737) of Chowan County.  Could this John be a son of John (b. 1684), son of Lawrence, that you mentioned?  If so, do you know the other siblings of the 1712 John and who the mother was?  Could you please tell me what the resources were that you found in the NC Archives?&lt;br&gt;&lt;br&gt;Thank you so much for your help.</description>

      <description>I believe the information available indicates that Luke III was the son of Luke II. His wife was named Sarah and it is commonly accepted that she was the daughter of Judge William Charlton even though we have no proof. It is also believed that William Charlton was married to Susannah Smithwick, again no proof. Luke testified in an affadavit that he was born 1683 and married in 1703.&lt;br&gt;&lt;br&gt;My information shows his children as:&lt;br&gt;&lt;br&gt;Charlton- Born cir 1705, he witnessed at least two documents in 1737 and he probably died in 1737-8 as I have found no other record with his name. Susannah witnessed these documents also and when Luke later deeded land to her he included a 7 year right of revocation, a provision  that was not in other deeds to his children. She could be the widow of Charlton. Susannah married Richard Tomlinson.&lt;br&gt;&lt;br&gt;Mary- Born cir 1710. she was deeded land adjacent to her fathers'. She married Edward Collins and when their son, Edward Collins sold the land he included a provision to protect her grave site.&lt;br&gt;&lt;br&gt;Luke IV- Born cir 1712. He was deeded land and after his father died he moved to Duplin County, NC and then to South Carolina near the Savannah River. After Susannah's death, she leaving no heirs, he sold the property giving his residence as SC.&lt;br&gt;&lt;br&gt;Elizabeth-Born cir 1715. Her father also deeded land to her and she married Charles Burch.&lt;br&gt;&lt;br&gt;Martha- Born cir 1719-20. She also received land and was married first to James Leggett, second to Richard Tomlinson, third to Hezekiah Ponder.&lt;br&gt;&lt;br&gt;The information I have indicates John to be the son of Lawrence, born 1650.&lt;br&gt;&lt;br&gt;I found this information on a number of visits to the North Carolina Archives.&lt;br&gt;</description>

      <description>As far as I have been able to determine, Luke II, William and John Mizell all had a son named Luke. It is commonly thought that Luke Mizell II married Sarah Charlton, daughter of William Charlton. A prominent North Carolina researcher, William Bennett, who had done exensive work on the Smithwick Family said he had never found proof or seen the name in any of the old documents.&lt;br&gt;This Luke Mizell II was the son of Luke Mizell I. There are some sources that state he was the son of Lawwrence, but I have followed the Mizell family line and only the descendants of John, son of Lawrence, have used the name Lawrence or Bethina for their descendants.&lt;br&gt;My mother was a Mizell and I have worked on this family for years. I acknowledge some information cannot be proved but conclusions have been reached by a number of researchers.&lt;br&gt;Will provide more information if you would like to ask questions.&lt;br&gt;&lt;br&gt;</description>

      <description>I am trying to verify some information in my family line and want to make sure this information is correct (it is collected from other rootsweb info and not personally verified) -&lt;br&gt;&lt;br&gt;Luke Mizell III (1683-1756) is probably the son of Lawrence Mizelle (son of Luke I, 1614-1673) and was married to Sarah Smithwick Charlton.  Their children were -&lt;br&gt;&lt;br&gt;John (1712-1847)&lt;br&gt;Charlton (1710-1740)&lt;br&gt;James Edward (b. 1716)&lt;br&gt;Luke (1722-1768)&lt;br&gt;Mary (1723-1738)&lt;br&gt;William (1725-1793)&lt;br&gt;&lt;br&gt;Please correct any of the dates that are not correct and let me know where you got your information.       <description>Since this was originally posted in 2004, you may have already found this info.  However, I have just been reading lots of the old postings and came across this one and found a date error.  Just to make a connection, I am a decendent of this Mizell line.  Jefferson Davis Mizell was my great, great grandfather, Willie Mizell and Lela Voth were my grandparents and Dave Mizell was my father.  The mistake in this posting was on Dave Mizell's birthdate.  He was actually born on Dec. 14, 1936.  I figured this was just a typo but just wanted to let you know.  I don't know if I can help anyone since I just do this in my spare time (which I don't have much) but if anyone would like to contact me I would help as much as I can.</description>

The solution was found by Marilyn Wilkey’s finding John Yancey Baynes’ will in Livingston County, KY, which names the “infant girls” as heirs to his estate. &lt;br&gt;&lt;br&gt;From Livingston Co. KY Salem Court records in the City of Salem ( Old Salem was the County Seat at this time for Livingston Co.1809-1841 in 1801 County seat was Eddyville now this city is in Lyon Co KY than next County seat for Livingston Co. KY 1804 Centerville finally in 1841 County seat was Smithland KY all of the records was move there ) &lt;br&gt;Yancy Baynes 4 Apr. 1831 Certificate of Letters of Administration granted to Polly Baynes widow and Reict of Yancy Baynes dec'd Polly entered into bond with WM. McCroskey and Jo. R. Given her securities. Enoch Dooly Wm. Abbington, George Roberson. Wm. Higgs and John Higgs or any three of them appointed to appraise the personal estate and slaves, if any, of Yancy Baynes dec'd [CoCt] Order Book H] No date Inventory and Sale bill of estate of Y. Baynes dec'd Buyers James Baynes, Jonah Hibbs, Joseph James, William Abbington, David Fort, Jacob Eason, John Ross, Philip Bearden, Mary Baynes, Malinda Shaw [ Inv App &amp;amp; Sale Book B.p.129] 9 Aug 1832 An inventory of appraisement sale of the estate of Yancey Baynes returned and ordered recorded Robt. C. Bigham appointed to settle with Mrs. Baynes her administration of said estate 1 Oct 1832 Mary Baynes admr. of Yancey Baynes dec'd filed the following account against the infant heirs of Yancy Baynes against Louisa for boarding &amp;amp; $20 against Leticia for same, $25 against Elizabeth, $30 against Jno Young Baynes $35. These accounts are allowed. {CoCt Order Book H}  &lt;br&gt;&lt;br&gt;The daughters are Leticia Baynes born about 1823 in Livingston County, KY probable died in Massac County, IL. She married John Ward Mizell on 27 June 1841 in Johnson/ Massac County, IL. John Mizell was born 1818 in Bertie County, NC died in December 1864 in Massac County, Illinois. This also gives the correct spelling of her name; it was difficult for me to read on the 1860 Massac Census.&lt;br&gt;&lt;br&gt;Louisa Baynes born 1824 in Livingston County, KY probable died in Massac County, IL. She married Demby Mizell on 6 Aug 1841 in Pope County, Illinois. Demby was born in 1822 in Bertie County, North Carolina and died in Massac County, IL.&lt;br&gt;&lt;br&gt;Elizabeth Baynes born 1829 in Livingston County, KY married Isaac Mizell was born 1827 in Bertie County, NC. They both probable died in Livingston County, KY.&lt;br&gt;&lt;br&gt;I thought that this information may be of interest, because of the many Mizell dissidence from these marriages. I am hoping that additional supporting information will now be found. I am descendent through Demby Mizell.       <description>My greatgrandfather was born Elmer Emmett Clemens in Red Bird Missouri as a young born he was taken into a Mizell family and they raised him.  We are trying to find out if they did indeed adopt him or if he just took their name.&lt;br&gt;A cousin, Barbara Reed, pointed out the 1900 census to me I would of never thought to intentionally misspell the name, it lists Robert G. Mitzell (Mizell) and wife Sarah E or J can't tell.  This couple is listed as born in Tenn and that their parents are born in Tenn&lt;br&gt;My gtgrandfather is listed as Clemens, Emitt C or E they flipflopped his name was really Elmer Emmett Clemens states took this boy to raise, and further over states this boy was taken to raise, parent dead.  Elmer was actually born 14 April 1891 as per his service records and death certificate.  So he was under 10.  If anyone has information on this Mizell family that took him in I would really appreciate it.
