Daisy, your Nehemiah Scott (d. 1801, Sampson Co., NC) was the BROTHER of Joseph Scott, not his son. Joseph was b. before 1719, and Nehemiah was b. before 1723. What confuses researchers so much is that both Joseph and Nehemiah had sons also named Joseph and Nehemiah, so when the younger generation reached adulthood, there were 3 Joseph Scotts and 3 Nehemiah Scotts appearing in the Sampson Co. records. To make matters worse, your Nehemiah Scott Sr., and Joseph Sr.'s son Nehemiah BOTH died within months of each other in 1801! Even the county court combined both sets of probate records into one file! The only way to tell the papers apart is by who is listed as administrator -- your Nehemiah Sr.'s administrator was his widow Elizabeth (Atkinson?), while the younger Nehemiah died unmarried and childless, and therefore had his sister's husband (another Magee!) serve as administrator.
