      <description>Thomas Upton Jr. died unmarried.  See history below by a son of Fleming Cobb and note that Thomas Upton Jr. divided his estate among his siblings when he died in 1794.&lt;br&gt;&lt;br&gt;The Peytona Herald, Peytona, Boone county, West Va May 31, June 14, 21 and 28, 1894&lt;br&gt;&lt;br&gt;EARLY SETTLERS The Trials and Troubles They Encountered While Exploring The Wilds of What is Now Boone, Kanawha and Mason Counties (By Thomas Upton Cobbs)&lt;br&gt;&lt;br&gt;In the Herald of November 30, 1893, I saw something said about Fleming Cobbs. I will now, at this late date, tell you something about him, some other pioneers of this part of the country, and, also concerning the origin of the name of certain creeks, and etc..&lt;br&gt;&lt;br&gt;Fleming Cobbs was born in Buckingham county, Virginia, near the Court-house. The date I do not know. His mother died when he was small. When he arrived to the age of fifteen years he enlisted as a soldier in the revolutionary war and served ninety days. He was a substitute for a man by the name of McIntosh. When the war was closed he came home.&lt;br&gt;&lt;br&gt;Fleming's father's name was Thomas Cobbs. He was an Englishman. He married a second time, so when Fleming came home he and his stepmother disagreed. He met Thomas Upton at his father's home. Mr. Upton was a surveyor and an old bachelor. He had received a land warrant from Governor Dunmore previous to the revolutionary war. Governor Dunmore was the last colonial governor of Virginia. This land warrant was, presumably, for services in the Indian Wars. He (Upton) went and spent a winter at old Fort Donald, on Muddy creek, in Greenbrier county, now West Virginia and from there moved further west to Lewis' fort at Point Pleasant, where he had to pass another winter. Indian hostilities were plenty, in which he participated.&lt;br&gt;&lt;br&gt;He laid his warrant on the South side of Kanawha river, two miles below Charles Clendenen's fort, where the city of Charleston now stands. he died and was buried in a hollow walnut log within the confines of the fort. In those days the early pioneers had no coffins to bury their dead in and had to dig the graves with clapboards, and when William Goshorn dug the basement of his fine house he threw the hollow log out with Thomas Upton's bones in it. The log was sound as a dollar.&lt;br&gt;&lt;br&gt;When Upton had laid his warrant he went back east to Thomas Cobbs', who was his brother-in-law, Cobbs having married Upton's sister for his first wife.............</description>

      <description>I'm confused about this supposed 2nd wife named Martha? &lt;br&gt;&lt;br&gt;Mary Heritage Upton outlived Thomas Upton.&lt;br&gt;Thomas Upton died in 1745 &lt;br&gt;his wife Mary died in 1775 Buckingham&lt;br&gt;&lt;br&gt;Children:&lt;br&gt;&lt;br&gt;Thomas Upton (moved to Kanawha County)&lt;br&gt;Mrs. Rebecca Upton Thomas Couch (died in Buckingham County)&lt;br&gt;Rachael Upton&lt;br&gt;Nancy Upton&lt;br&gt;Joseph Upton&lt;br&gt;&lt;br&gt;"Lenard Ballow Junr, John Childers &amp;amp; Willimington Harris to appraise the&lt;br&gt;esate of Thomas Upton dec'd.&lt;br&gt;25 Jul 1745" &lt;br&gt;&lt;br&gt;"Attachment of William Cabell, Gent. against William Sherlock, sheriff returned attachment, executed by James Freeland and Mary Upton the garnishees who made oath that they had no effects of said Sherlock, plaintiffs ordered dismist. Last Will and Testement of Thomas Upton deceased proved by Wilmington Harris ordered to be recorded. Mary Upton, executrix named, took oath and certificate is granted for obtaining probate and she enters into bond with William Cabell, Gent., Lenard Ballow Jr., John Childers, and Wilmington Harris, or any two of these, ordered to appraisethe personal estate of Thomas Upton deceased." &lt;br&gt;&lt;br&gt;&lt;br&gt;There are many deeds in Albemarle County referencing Widow Mary Upton.  Mary Upton also appears in various Almebarle Court records over the next few years after the death of Thomas.&lt;br&gt;&lt;br&gt;Her son Thomas Upton came to Kanawha County and died "an old bachelor" according to the early histories of Kanawha.  He left a Will dividing his fortune to his siblings and their children.&lt;br&gt;&lt;br&gt;In the name of God, Amen.  I, Thomas Upton, Kanawha County, make this&lt;br&gt;my last will and testament.  I resign my soul to its Creator all humble hopes&lt;br&gt;of its future happiness as in the disposal of a being infinitely good; also&lt;br&gt;my body and it is my will that it be buried in a Christian manner.&lt;br&gt; As touching my worldy affairs wherewith it has pleased God to bless me with,&lt;br&gt;I hereby appoint my particular friend and nephew Fleming Cobbs, executor of&lt;br&gt;this my last will and testament.  I do will and bequeath to my brother,&lt;br&gt;Joseph Upton the half of that tract of land lying below Davis Creek which&lt;br&gt;part he is to have at the lower end.  I do will to my nephew Thomas Cobb, son&lt;br&gt;to Thomas Cobb of Buckingham County, the half of that part of said tract that&lt;br&gt;lies above Davis Creek.&lt;br&gt;  I do will to Thomas Upton, Joseph Upton, Elia Upton and Elijah Upton, sons&lt;br&gt;of Joseph Upton, each 200 acres of land of a certain tract of 1400 acres on&lt;br&gt;Cole River at the Upper Falls.  Of the other 600 acres to be equally divided&lt;br&gt;between India Cobbs and Mapprin (?), daughters to Thomas Cobb, Rebeckah&lt;br&gt;Thomas, daughter to Rebeckah Couch.&lt;br&gt;  I do hereby will to Marah Toler, daughter to Thomas Cobb, my negro woman&lt;br&gt;named Tillah together with her increase.  I do will to Rebeckah Thomas, my&lt;br&gt;negro woman named Nan together with her child.  I do will to Nancy Cobb,&lt;br&gt;daughter to Thomas Cobb, my negro woman named Pallis. David was born April 15, 1846 in S.C. deid sept. 6, 1931,married dec. 30, 1867 Etowah Co., Al. to Emma H. Puritt born dec. 16, 1848 Al. died july 4, 1930 both are buried Beulah Cem., near Fyffe, DeKalb Co., Al. David and Emma had five children that I know of 1. Walter M. b. about 1867 S.C. 2. Julia b. about 1870 Etowah Co. Al. 3. Marguett A. b.Dec. 22, 1872 Etwah Co., Al. d. June 18,1947 Buried Beulah, married Drew S. Ridgeway 5. Charlsie b. about 1874 Etowah Co., Al. 6. Nancy Lula born March 21,1879 Etowah Co., Al. d. Jan. 15, 1921. Buried Beulah, married William Caswell Johnson Dec. 11, 1898 DeKalb Co., Al. I have William and Nancy children. David parents were James and Charity (unknow last name) Upton. They had 11 children. 1.Delila, 2.Robert, 3.Sarah, 4.Nancy, 5.William, 6.Samuel, 7.Larania, 8.David, 9.Frances, 10.James, 11.Tobias The information on James came from 1850 Richland S.C. census. Came to Sydney Australia on a ship named 'Neptune' in 1790. Died 1827. &lt;br&gt;Sarah Hoskins (Pigg) born in England in about 1772. Came to Sydney Australia on a ship named 'Mary Anne' in 1791. It is very important to my family and I that we get ahold of him somehow. &lt;br&gt;He was last known in 2002 to live in Roseville CA. His wife Olive Clayton passed then. My great grandmother was sarah upton, she married a frank sims who was born in Germany but was a british subject, I know they had a daughter called sarah, not sure when she was born but she was the 4th child to be born. My great grandparents were married in 1875, so it might well be the same. They lived in Aberavon south wales all their married lives. Hope this is of some help. Hillery Lanham), Archibald and Eleanor (m. Dominic Havener).  Thomas had by his first wife, who was unnamed in his will and estate records two children John and Sarah.  Sarah married Frances Wheat. I have copies of the will and estate records to support this information.</description>

It's hard to get farther up than that b/c only his mom's name, Samantha Upton, is on the death cert - no father's name listed.
