Orice Foster to Henry Boyer
1/6 of 1/14 of Henry Wigingtons Estate
This Indenture made and entered into this twenty sixth June one thousand Eight hundred and forty four by and between Orice Foster of Clark County KENTUCKY of the first part & Henry Boyer of the county of Bourbon and state aforesaid of the second part, Witnesseth: that whereas the said party of the first part is entitled by descent to one equal individual sixth part of one equal undivided fourteenth part of the Estate real personal and mixed and choses in action that belonged to Henry Wigington Sr. now deceased and late of BOURBON COUNTY KENTUCKY at the time of his death and which interest was derived to him through his late mother, Jemima Foster who was a child of said Henry Wigington Sr. and who departed this life before the death of said Henry Sr. & whereas the said party of the first part is entitled by purchase to the interest of his sister Permelia Collins and Albert G. Collins her husband in the Estate of said Henry Wigington Sr. deceased which interest is the same in quantity as that derived to said party of the first party by descend to as aforesaid and which has been conveyed by DEED now of record in the clerks office of the BOURBON COUNTY court. Now in consideration of the sum of Four hundred dollars by said party of the second part in hand paid, the receipt whereof is hereby acknowledged, the said party of the first part hath bargained and sold conveyed and confirmed and by these presents doth bargain and sell alien convey & confirm unto the said party of the second part the two interests aforesaid of him the said party of the first part in and to the Estate that belonged to the said decedent Henry Wigington Senr. at the time of his death whether in the hands of his Administrator Executor or Committee, and whether the same consists of lands, slaves, bonds, notes, money, stock or other personalty and choses in action. To have and to hold the Estate and interest therein aforesaid unto him the said Henry Boyer his Heirs and assigns forever--and the said party of the first part hereby covenants for himself his Heirs Executors & administrators to warrant and forever defend to said Boyer his heirs Executors administrators and assigns the right title and interest in and to the Estate hereby conveyed against the claim or claims of any and all persons whatever. In testimony whereof the said party of the first part hath hereunto set his hand and seal the day and year first above written. Interlineations and erasures made before signing & sealings.
