Harvey Poe Shot, Badly Wounded

Harvey Poe aged about 48 was shot and wounded by Jesse Patrick, 58 in a shooting affray in the Mt. Pisgah community, 16 miles southwest of Conway near the Pulaski-Faulkner County line about 9 o'clock last night. Poe is in the Faulkner County Hospital. He was shot 1 time in the right side. His condition this afternoon was said to be acute.

Patrick made bond with $500.00 for his appearance in municipal court here next Monday. He is charged with assault with intent to kill. Patrick and his son-in-law operate a store at Mt. Pisgah in Pierce Creek TWP. said that Poe and another man John Doss had loitered around their store and home about 2 hours in a drunken condition and that Poe was shot after he and Doss broke down the front door of the store. Patrick and Cartwright live in the back of the store. Patrick said a third man, Carroll Gore had sought to persuade the 2 men to go home before the shooting.

Patrick said he fired twice in the dark after the door had been broke down. He said he did not know which man he had shot until a light was turned on. Doss fled after the shooting.

Sheriff Summers issued warrants for the arrest of Poe and Doss on charges of drunkness and disturbing the peace. The arrest of Doss was expected to be made today.

D.C. Moody, a Justice of the Peace of Pierce Creek TWP, brought both Patrick and the injured man to Conway in the same car. He said the roads in his community where in such bad condition that he was forced to drive by Blue Hill Garage in Pulaski County to reach here.

Poe was placed on the operating table at the Hospital soon after reaching here and physicians removed the buckshot from his side. He is a farmer , but formerly worked for Frauenthal & Schwarz Inc., He is married and the father of several children.

Funeral services for B. Harvey Poe, aged 45, victim of a shooting affray in the Mt. Pisgah Community last Sunday night, were held this afternoon at Mt. Vernon in charge of the services, Dr. E.P.J. Garrott, pastor of the First Baptist Church of Conway. Poe's Death occurred early yesterday at the Faulkner County Hospital . Internment was made in Mt. Vernon Cemetery., in charge J.A. Pence and Son. (Note, Burial is in Heffington Cemetery near Mt. Vernon)

Poe's brothers, Amner Poe of Cabot, J.F. Poe of Epps, Louisiana, and E.E. Poe of Little Rock, and his sister, Mrs. Mildred Aquistpace of Paris arrived last night to attend the funeral.

B.H. Poe Funeral Delayed
The funeral of B. Harvey Poe, 45 year old victim of a shooting affray in the Mt. Pisgah Community was delayed when the funeral director found no excavation had been made for the grave. Funeral Services and Internment were held today.

Mt. Pisgah Man Fined In Local Court.

John Doss of the Mt. Pisgah Community entered a plea of not guilty to a charge of drunkenness today when arraigned in the court of Municipal Judge Rolland Bradley and the court ordered him to serve 30 Days in jail. Doss was also convicted of disturbing the peace and fined $50.00 costs. Witnesses said Doss was the companion of B. Harvey Poe when Poe was shot to death by Jesse Patrick at Floyd Cartwright's store the night of Dec. 19. After accessing the fine and jail sentence, Judge Bradley said the latter would be suspended pending payment of the fine and good behavior.

The state is Arkansas. I found the obit. and other data for the first wife online. Sallie Ann "Annie" FLOWERS (31 Mar. 1897 [Bible], Mt. Nebo, Faulkner Co., AR - 22 Mar. 1924, Little Rock {Hospital}; bu. Mt. Vernon; dau/o Sarah Ellen DAVIDSON & Joseph Ward FLOWERS) m. ca. 1917, Benjamin Harvey POE, who remarried in 1933. Services were held at the home on East Oak St., Conway, AR. She was survived by her husband and ch. Mildred, 9; Wm./Howard, 6; & Sylvia, 3. She was also survived by her mother; four brothers: W. T. FLOWERS, Conway; R. E. & J. W., Mt. Vernon, & J. T. of Holland; & brothers-in-law John & Farley POE (who arrived during her illness).
