26 February 1700 - George Eskridge on behalf of James Courtnell and Mary Courtnell and rest of children and orphants of James Courtnell petitioned Thomas Garland, Nathaniel Garland and Samuel Rust to divide the estate of James Courtney into seven equal shares, giving son James Courtnell and daughter, Mary Courtnell first choice John Courtnell, Hannah Courtnell, Frances Courtnell, Martha Courtnell and William Courtnell, to divide the rest of the estate equally.

JAMES COURTNEY took guardianship of his siblings, WILLIAM COURTNEY and HANNAH COURTNEY; WILLIAM CARR assumed guardianship of JOHN COURTNEY; JOHN JENKINS (Uncle) took guardianship of FRANCES COURTNEY; VINCENT COX assumed guardianship of MARTHA COURTNEY; VINCENT GARNER assumed guardianship of MARTHA COURTNEY.

I notice the switching between courtney and courtnell is this transcipt error or a common occurance. Do you have any information on this as it doesnt make sense?

Spelling was not considered a necessary art form then. I have seen Courtney, Courtnoe and Courtnell all in the same paragraph.
