Former Bank Teller Pleads
Guilty To Three Charges
ADA, Okla., Oct. 17.— AP— Mrs.
Elizabeth Dooley, 31, pleaded guilty
today in federal court to three
charges in connection with the
$26.714.70 robbery of the First State
Bank of Idabel last Feb. 14.
U. S. District Judge Eugene Rice
fined the former teller in the Idabel
bank $500 on a conspiracy count
and sentenced her to two years In
prison on each of the other counts
— entering the bank and bank robbery
— then suspended the sentences
which were to have run consecutively.

Mrs. Dooley Said

—Alleged to have loaned a
friend keys to the Idabel State
bank where she worked as a
teller. Mrs. Elizabeth Dooley. 30,
remained in jail today unable to
make $5,000 bond after being
charged with conspiracy.
D. A. Bryce, FBI agent in
charge, said Mrs. Dooley's arrest
climaxed a careful sifting of evidence
by FBI agents after the
Feb. 13 burglary. The robbers,
after unlocking the front door.

doors behind them.
Arrested At Bank
Mrs. Dooley was arrested by
U. S. Marshal Granville Norris
and FBI agents at the bank vesterday.
Norris said she told him
she loaned her keys to a friend
who had duplicates made.
Four others were under arrest
on charges growing out of the
burglary. The robbers took $2,500
in cash and checks totaling $25,-
000.
Bryce said a portion of both the
cash and checks had been recovered.
Some of the checks were
fished from a creek near Fort
Towson a few days after the
burglary.
The FBI agent said the warrant
for Mrs. Dooley was made out
for Mary Doe by the Muskogee
grand jury recently and that her
arrest was held up pending completion
of investigation.
Arraigned Twice
Mrs. Dooley was arraigned
twice yesterday, first at Antlers
where her bond was set at $2,000.
U. S. District Attorney C. A.
Summers decided she should be
arraigned in Muskogee since the
original complaint was filed here.
U. S. Commissioner Forrester
Brewstcr set the second bond at
$5.000.
Summers said the charge accused
Mrs. Dooley of conspiring
with Jack Gibson Moss, one of
the defendants, to assist in the
burglary by providing a combination
and keys.
Moss, arraigned yesterday before
Brewster, requested another
day for pleading and preliminary
bond was set at $10.000.
Others indicted in the case included
John Thomas Duncan, Joseph
Junior Larson, and Everett
Junior Pact, all held in Fort
Worth.

Hello Carol, my grandpa is James Pack Sr. Any information on the family that you have would be awesome. I only have as far back as Van E. Pack Sr. and Paula Krouse. My oldest son is almost 13 and loves history, especially to do with our family. I remember my grandma, Maudie talking about you before she passed away.

May I offer my appoligizes for the infrenquency of my response. I have been unable to obtain support for what I have been told about he burial site of Mr Dixon, but today we were visiting our family's plot & there we have found Sim Dixon's head stone disturbed.

Not suggesting that the initial enturement of Sim Dixon was correct or not, someone has moved his headstone alignment with the rest of the cemetery.

I am trying to contact the local folks on this matter, but have not been able to find a contact point as of this evening. I shall to endevoir to persevior.

Final Rites Held For Early Settler

PORUM, March 24-(Special)-

Funeral services were held her Saturday afternoon
for J.C. West, 87 years old, who died at the home
of his daughter in Muskogee.

West a one of the oldest citizens of Muskogee county,
and spent his entire life in eastern Oklahoma. He
resided near Porum for more than 40 years, but for
the past three years has lived in Muskogee.

He was an Indian policeman for many years, and was the
first deputy United States marshal in this part of the
country.

270-Pounder Kept "Lid" on Atoka County --- Unlike TV Heros, He Rarely Wore Gun

McAlester - At 80 years, Jesse W. Phillips is a gentle man of scholarly appearance. His
hair is snow white, and his face bears the etch of his frequent smile. He probably is one
of the last persons anyone whould pick out as the real-life prototype of a television
marshal.

Yet, this same Jesse Phillips was one of the first sheriffs elected to office after
Oklahoma became a state. He, in fact, is the only living member of the
first county slate of officers elected in Atoka County back in 1907.

He has the distinction of being the only man now living who was sheriff
of a county that first year of statehood.

He shared the distinction with John E. Johnson of Sequoyah County for years until
Johnson's death about two weeks ago.

The retired McAlester man is still big - 6 feet 2 and a firm 210 pounds - but is no where
near the 270 - pound giant he was in post-Territorial days.

"I was pretty much a peace-maker, even before I was elected sheriff," Phillips will tell
you with a smile. "I didn't have to wear a gun too much, but I had three stashed away
at strategic places in Atoka just in case I needed one. I went after a few toughs, and I
always came back with then."

A native of Tishomingo County, Miss., where he was born Feb. 18, 1882, Phillips moved to
Caddo, Blue County, Choctaw Nation, Indian Territory, when he was 16. His father,
Gray W. Phillips was in the mercantile business in Burnsville, Miss.

"We were Mississippi Choctaws, and we came to Indian Territory to be Choctaws," the
octogenarian relates with a smile. "The court ruled otherwise, so my father abandoned
his hope of getting a big land acreage and opended a store at Caddo, now in Bryan County."

When he was 21, the younger Phillips bought a grocery store at Caney, Atoka County, with
his father's help.

"There was no organized law in Territorial days," Phillips recalls. "When a drunk
wandered into a store, the owners would call me to come and throw him out. I was a
pretty big, rough boy."

Phillips was operating his grocery store at Caney when statehood came. His father wanted
Jesse to run for county treasurer, but the strapping young merchant, then 25, decided he'd
rather be sheriff. He was one of five candidates for the first badge Atoka County was to
bestow on the victor.

"I polled 992 votes, only six of which came from the county seat," the McAlester man said.
"Election night, I went home, thinking I had lost. Friends woke me up about 3 o'clock
the next morning and told me I was sheriff. I had beaten out me next closest opponent by
91 votes."

If women and Negroes had been permitted to vote, Phillips' opponent likely would have won
the election, since his plurality in Atoka would have been much greater.

The new sheriff had two regular deputies, Tom Hosmer and Otis Presson, both now deceased.
Presson later was superior judge in Seminole County. Phillips drew $2,000 a year as
sheriff, while his deputies worked entirely on commission.

And to make certain county officials were not over-paid, banks discounted their monthly
warrants anywhere from 10 to 20 percent. Sheriff Phillips made money on his feed allowance
for prisoners. He received 60 cents a day for each of the first 10 prisoners in jail; 50
cents a day for eah of the next 10, and 40 cents a day for feeding each inmate numbering
above 20.

"I kept them out to work gangs," Phillips relates. "Most of the crimes were misdemeanors,
but I took the view I was in office to enforce the law. Outside work contractors would
feed my prisoners for 25 cents a day, so I made a good profit in the difference between
what the county paid in feed allowance and what it actually cost. Due to the fact most of
the crimes in the early 1900's were horse stealing, bootlegging and the like, Phillips
figures his duties were not too difficult.

"I had heap rather been sheriff then than to hold the same job now," he said earnestly.

Phillips took office in November 1907. He was re-elected to a second term in 1910, then
retired voluntarily to serve two appointments by President Woodrow Wilson as postmaster
at Atoka.

While Phillips was postmaster, Bob Sumpter, a Republican, was elected sheriff. Phillips'
friends talked him into running against Sumpter in 1919, and the erstwhile sheriff won a
third term. Sumpter later became deputy U.S. marshal and was killed by moonshiners in
Coal County.

An old political opponent, the laste O.P. Ray, unsealed Phillips as sheriff when the latter
sought a fourth term. Phillips returned to the grocery business in Atoka, but shortly
thereafter opened stores at Maud and Shawnee during the oil boom of the
mid-1920's.

In 1929, Phillips was named by Gov. W.J. "Bill" Holloway as assistant deputy warden of the
state prison under Warden John Q. Newell. He was there for six years, going out during
the E.W. Marland adminsitration. When Leon C. Phillips became governor, the early-day
peace officer was named deputy warden of the penitentiary under Warden Jess Dunn. After
1 1/2 years, he was named superintendent of the boys' training school at Stringtown.

Phillips was named postmaster of McAlester on Sept.1, 1943, and served in the office until
his retirement at age 70 in 1952. He then went back to the penitentiary for four years
as assistant deputy warden under the late H.C. McLoud.

Two of the 80-year-old's brothers and one sister are still living. They are John A. Phillips,
Durant, former sheriff and assessor in Bryan County; Graover C. Phillips, McAlester, one-time
treasurer of Atoka County, and Mrs Martha White, Berryville, Ark.

Phillips' son, Ferman, served three terms in the legislative house and two terms in the
senate from Atoka County before becoming secretary of the Oklahoma Education Association.
There also are two grandchildren and seven great-grandchildren.

Bits and pieces of interesting information keep popping into Phillips' stories about law
enforcement in years past. The former Atoka County sheriff attended the first Oklahoma
sheriffs' convention at Oklahoma City in 1908, for instance. And much of his work right
after statehood was done from a buggy, and the sheriff, unlike TV marshals, rarely wore
a pistol and holster.

"I could tell some tales of death and violence, but they seem out of place now," Phillips
said. This staement is completely convincing as he smiles from the big chair in the living
room of his comfortable home.

I have been researching John McIntyre b.abt.1830 in NC, d.1899 in Palo Pinto, TX. His first wife was Mary Jane Buchanan who died in Meeker County, MN in 1872. His second wife was Loudema Wright who died in 1926 in Palo Pinto, TX. After John McIntyre died, Loudema applied for a widow's pension based on her husband's service in Co. A, 39th KY.Inf. USA, 1862-1865. The pension file contains a sworn affidavit dated 13 Aug 1900 from Bill McIntire, McAlester, Oklahoma which states that he is 46 years old, he is the son of John McIntyre by his first wife Jane Buchanan who died in Meeker County, Minnesota in January 1872. His father was subsequtly married to Loudema Wright who is now his widow. His father never married but the twice.

My great grandfather was washington Tilford Middleton,born in Tenn in 1834. I believe his father was Washington Middleton, born in 1801 in Tenn. My grandfather WT Middleton was supposedly moved from E Tenn to W Tenn, to Illinois, then to Missouri & finally to Tex in the 1880s. He was a confederate calvaryman. I was told he had twin bros. One was John. He was killed by Belle Star. His twin in retaliation, killed Belle Star. I haven't personally verified this info.

Ike Wilkinson formerly a police captain under Baber,
but in the federal liquor service for the last year,
who went with Davidson and Plank to the Baber home,
escaped although two shots were fired at Wilkinson.

Telling the enforcement officers that he had no liquor
hidden at his home, Baber warned the officers not to
try to force an entrance. When the officers refused
to regard Baber's order to "stand back," Baber opened
fire with a double barrelled shotgun loaded with
buckshot. Davidson, with a six shooter in his hand
was killed outright and Plank died in a few minutes
after being shot. Neither officer fired at Baber so
far as is known.

Wilkinson took refuge behind a tree and after two shots
had been fired at him escaped.

Baber immediately notified police headquarters of what
he had done and asked that an officer be sent to arrest
him. Baber was arrested by Chief of Police Burns and
Patrolman Bewley. At police headquarters Baber talked
freely of the shooting, protesting that he fired to
protect his home.

officers will be held Friday. Officer Wilkinson, Baber
and Baber's wife will be the principal witnesses.

Marshal Davidson has been in charge of the government
liquor officers here for a year and has been very active
in the work of raiding whisky traffickers. He was a
candidate for sheriff of Creek county. Deputy Plank
formerly was a deputy sheriff at Claremore and his
people live in Claremore.

Excitement over the killing reached the fever point
Thursday night, when a score of speakers addressed an
indignation mass meeting of 2,000 people, held on a
downtown corner. The result of the meeting was the
sending of a telegram to Governor Lee Cruce, signed by
citizens, urging him to send Adjutant General Frank M.
Canton here with the power to put a ban on bootlegging
and gambling. This telegram was ratified by the
meeting enmasse.

Federal Aid Sought

A telegram signed by fifty members of the Law Enforcement
club was sent to United States District Attorney
Linebaugh, demanding that Chief Larson of the department
of justice and as many deputies as necessary be dispatched
to Tulsa with orders to close all whisky traffic at any
cost. It was suggested that at least twenty-five special
United States officers be stationed here immediately.
Action by the government is expected immediately. General
conditions in Tulsa were denounced by a score of speakers.
It was declared by one that Tulsa, as it now is, is not a
fit place for children to be reared. Rev. Lloyd, pastor of
the First Baptist church, said:

"Unless immediate steps are taken to renovate this city, to
reclaim it from the element now standing high, the better
people are going to move away. People are not going to rear
their children here: they are afraid to."

Others in similar terms flayed what they claimed were existing
conditions. Members of the Law Enforcement club have prepared
to offer at the meeting proof that gambling and bootlegging
are carried on in the city. As a result of the killing of
the government officers and the mass meeting Thursday night
a great crowd of reformers will be present at the session of
the commissioners.

Telegram to Governor

The following telegram, signed by two hundred citizens and
ratified by the mass meeting of two thousand, was sent to
Governor Lee Cruce:

"Governor Lee Cruce, Oklahoma City, Okla. Sir: Today
Holmes Davidson, deputy United States marshal, and his
assistant, Ed Plank, were killed in cold blood by
Bill Baber, notorious bootlegger of Tulsa.

"It appears that this murder was unquestionably done in
pursuance of a conspiracy to kill.

"A condition exists in this community which can no longer
be tolerated. We do not expect any assistance or law
enforcement from our county officers, therefore we appeal
to you, as governor of the state of Oklahoma. Law
enforcement is a farce and lawbreakers laugh at a righteous
public indignation. We must have relief instanter, and
respectfully ask that you use every power and authority
vested in you as governor of this state to see that the
laws are enforced in this community and that crime and law
violation, practically licensed by our officers, be
suppressed by any and every authority you possess as
governor. A petition to that effect is before you for action.

"We appeal to you to enforce the law. We would be glad if
you would send General Canton here at once with full authority
to act. We respectfully request that you act at once,
positively and effectually. Will you act? The above telegram
was read at a mass meeting of two thousand people and ratified
by them. (Signed).

Alice Louisa Pearson was my gggrandmother. I am doing research on the Hunter and Pearson families, and could use any help (information, pictures, etc.) of Alice or any of her siblings, ancestors, etc. I would appreciate any information anyone is able to share with me.

hello, i find you again, i am the granddaughter of della mae peeler her father was thomas newton pearson wife of nanny louella . this is so confussing to trace. nute remarried mary ella keyes and they had two more kids. your mother is she mary ella or nannie louella? my email is melissalnnmnn@msn.com my aunt betty -daughter of della mae yates she has tons of old photos i am hoping to locate some and post them.. anyhow lets figure this out. thanks melissa. looking at your post your from the second marriage. i might have the names confused but i do know we must be related on thomas nute side, so that would make it something like your my grandmothers half brother or sister relations. right?????

He was also my ggrandfather. He was married to Martha Estep (Brashiers). He is buried beside her in the Northtown cenetery. After he was killed his deputy went after the man and killed his and then married Martha. His name was EDwards. He is also buried there as is Martha's father Ivy Estep a dr in Union army. He had a great big tall headstone giving the number of the army. I am a grandaughter of Arthur Stanton.

hello my name is Tressia Hollis Rawls My Grandmothers name was clara May Middleton dement She has told me a story about Uncle John the story is that when they were small and all having to leave tennessee he was way down at a neighbors and they had to leave so they left him and did not know what happened to him later we found out that this was Uncle John that was with Bell star if interested I have a little ancestry His Brothers names ETC thanks

Belle Starr, Outlaw & Horse Thief, born: Carthage, Missouri, Feb. 5, 1848, d. Feb. 3, 1889 near Eufaula, Oklahome. Born: Myra Belle Shirley, married Cherokee~ Sam Starr~ AKA~ Blue Duck (outlaw- ex gang mem., of Jesse James). Belle was an old neighbor & friend of Jesse James.

Services Held For Murdered Night Marshal

STUART - Services for John T. Martin, 57, night marshal
killed in a gun battle with burglars at Carnegie, were
Saturday in the First Baptist Church.

Martin was killed in a gun battle with two men suspected
of stealing gasoline. He had been night marshal at
Carnegie since February.

He had lived in the Stuart vicinity for a number of years.
He was born June 4, 1902 at Beeville, Texas. He was
employed at the US Naval Ammunition depot, south of
McAlester, in the middle 1950's.

Survivors are his wife, Mrs Louisa Martin, Stuart; a
daughter, Mrs Addie Reeder, Stuart; a son, Alfred Lee
Martin, Stuart, three sister and three brothers.

Marshal Kills Man in Brawl

HASKELL, Jan 31 -(AP)-

Danny Walters, 29, a Haskell cafe owner,
was shot three times and killed Saturday night
at the climax of a street brawl here with City
Marshal Jim Jobe, 41.

Jobe was under technical arrest at the county
seat in Muskogee Saturday night while the sheriff's
office, highway patrol and Muskogee County Attorney
Chester Norman investigated the affair.

Jobe said he saw Walters stagger on the sidewalk on
the way to his car, apparently intoxicated. Jobe
told him not to drive, and there was a scuffle over
the car keys. The scuffle turned into a fist fight
and Walters who weighed 220 pounds, loosened some of
Jobe's teeth.

The marshal said he then tried to put Walters under
arrest but the latter shoved his right hand in his
pocket and continued to pummel Jobe with his left.

Jobe said he drew his pistol and shot Walters in the
leg, without apparent effect, and then shot him in
the chest and temple, killing him. Two pocket knives
were found later in Walters' pocket, Jobe said.

Marshal Killed At Krebs in Gun Fight

M'ALESTER, Dec.31 -(AP)-

Shot by the nephew he deputized to aid him
arrest a drunk, John Parker, city marshal
of Krebs, died late Sunday.

Witnesses said Lee Parker fired at Clifton Logan,
when the latter allegedly threatened Parker, seeking
to arrest Jack Winningham, a railway mail clerk.

Parker was struck and fatally wounded and Logan was
wounded critically. Winningham was held in the
county jail.

BANDITS WIN PITCHED FIGHT; 1 DEAD, 2 HURT

Nowata, Okla., Jan 6 -

One is dead, another is dying and a third is
seriously wounded as the result of a pitched
battle late today between a citizens' posse
and fifteen bandits, eighteen miles mortheast
of Nowata. The dead and wounded were members
of the posse, which was routed by the bandits,
believed to be the Roe-Hart gang of robbers
that has terrorized the banks of northeastern
Oklahoma for several months.

Delaware Marshal Killed

City Marshal Bullock of Delaware is dead. John
Garretson of Delaware is dying with a bullet hole
through his head. His brother, Newton Garretson,
is seriously wounded, but physicians tonight said
he would recover. Whether any bandits were killed
or wounded is not known.

BODY OF BRAVE YOUNG OFFICER LAID TO REST

Special to The Oklahoman.

Checotah, Okla., March 29 -

Probably the largest crowd that ever assembled in Checotah
attended the funeral today of Herman Odom, son of Sheriff
W L Odom, who was killed in a fight with the Snakes at the
home of Chitto Harjo last Thursday evening. The funeral
services were held at the Baptist church at 2 p.m., conducted
by the Rev. D.E. Millichamp. The Modern Woodmen lodge, of
which young Odom was a member, attended in a body. All the
business houses were closed for two hours.

Herman Odom was 22 years old. He has been in this country
for a number of years and for two years has been doing service
for his father as a deputy. He was well known and popular.

The body of Edward Baum, city marshal, who was killed in the
battle Thursday evening, was shipped to Fort Smith, his former
home, for interment.

OFFICERS WHO SLEW MEN ARE REFUSED BAIL

MARSHALS WHO KILLED TULSA PREACHER MUST REMAIN IN JAIL

Special to The Oklahoman.

Tulsa, I.T., Oct 11 -

Judge Lawrence in federal court tonight denied an appeal from
a decision given three weeks ago in which the court refused
bail on a habeas corpus to C.E. Wilson and Frank McGlothlin,
deputy United States marshals, indicted for first degree
murder for the killing of the Rev. Sylvester Morris. The
officers will be compelled to remain in the federal jail at
Muskogee until their trial, which may be heard in a state
court.

The Rev. Mr. Morris was mistaken by the officers in the dark
here for a bootlegger several months ago, as he was returning
home from the country and was shot and killed when he failed
to halt at the word of command. He was quite deaf, which it
is believed was the reason he failed to obey the officers
command. He was a retired Methodist minister and wealthy.

WILL POWELL SLAIN BY A TOWN MARSHAL

KILLING FO BOY PROVOKES MUCH EXCITEMENT AT TAHLEQUAH

Special to The Oklahoman.

Muskogee, I.T., Nov.30 -

Will Powell, a boy sixteen years old, was shot and killed
at Tahlequah by John Sharp, city marshal of that town and
an ex-member of the Cherokee legislature.

The slaying of the lad has caused intense excitement as it
is alleged that Sharp was drunk and that the murder was
unprovoked.

Young Powell was a nephew of Bud Ledbetter of this city,
famous as one of the ablest and most fearless deputy
United States marshals in the Indian Territory.
