S. District Judge Eugene Rice&lt;br&gt;fined the former teller in the Idabel&lt;br&gt;bank $500 on a conspiracy count&lt;br&gt;and sentenced her to two years In&lt;br&gt;prison on each of the other counts&lt;br&gt;— entering the bank and bank robbery&lt;br&gt;— then suspended the sentences&lt;br&gt;which were to have run consecutively.&lt;br&gt;&lt;br&gt;Ada Evening News&lt;br&gt;Ada, Oklahoma&lt;br&gt;27 March 1946&lt;br&gt;Page 1 &lt;br&gt;&lt;br&gt;Mrs. Dooley Said&lt;br&gt;To Have Loaned&lt;br&gt;Idabel Bank Keys&lt;br&gt;&lt;br&gt;MUSKOGEE, Okla., March 27.&lt;br&gt;—Alleged to have loaned a&lt;br&gt;friend keys to the Idabel State&lt;br&gt;bank where she worked as a&lt;br&gt;teller. Mrs. Elizabeth Dooley. 30,&lt;br&gt;remained in jail today unable to&lt;br&gt;make $5,000 bond after being&lt;br&gt;charged with conspiracy.&lt;br&gt;D. A. Bryce, FBI agent in&lt;br&gt;charge, said Mrs. Dooley's arrest&lt;br&gt;climaxed a careful sifting of evidence&lt;br&gt;by FBI agents after the&lt;br&gt;Feb. 13 burglary. The robbers,&lt;br&gt;after unlocking the front door.&lt;br&gt;vault, then departed,locking the&lt;br&gt;doors behind them.&lt;br&gt;Arrested At Bank&lt;br&gt;Mrs. Dooley was arrested by &lt;br&gt;U. S. Marshal Granville Norris &lt;br&gt;and FBI agents at the bank vesterday.&lt;br&gt;Norris said she told him&lt;br&gt;she loaned her keys to a friend&lt;br&gt;who had duplicates made.&lt;br&gt;Four others were under arrest&lt;br&gt;on charges growing out of the&lt;br&gt;burglary. The robbers took $2,500&lt;br&gt;in cash and checks totaling $25,-&lt;br&gt;000.&lt;br&gt;Bryce said a portion of both the&lt;br&gt;cash and checks had been recovered.&lt;br&gt;Some of the checks were&lt;br&gt;fished from a creek near Fort&lt;br&gt;Towson a few days after the&lt;br&gt;burglary.&lt;br&gt;The FBI agent said the warrant&lt;br&gt;for Mrs. Dooley was made out&lt;br&gt;for Mary Doe by the Muskogee&lt;br&gt;grand jury recently and that her&lt;br&gt;arrest was held up pending completion&lt;br&gt;of investigation.&lt;br&gt;Arraigned Twice&lt;br&gt;Mrs. Dooley was arraigned&lt;br&gt;twice yesterday, first at Antlers&lt;br&gt;where her bond was set at $2,000.&lt;br&gt;U. S. District Attorney C. A.&lt;br&gt;Summers decided she should be&lt;br&gt;arraigned in Muskogee since the&lt;br&gt;original complaint was filed here.&lt;br&gt;U. S. Commissioner Forrester&lt;br&gt;Brewstcr set the second bond at&lt;br&gt;$5.000.&lt;br&gt;Summers said the charge accused&lt;br&gt;Mrs. Dooley of conspiring&lt;br&gt;with Jack Gibson Moss, one of&lt;br&gt;the defendants, to assist in the&lt;br&gt;burglary by providing a combination&lt;br&gt;and keys.&lt;br&gt;Moss, arraigned yesterday before&lt;br&gt;Brewster, requested another&lt;br&gt;day for pleading and preliminary&lt;br&gt;bond was set at $10.000.&lt;br&gt;Others indicted in the case included&lt;br&gt;John Thomas Duncan, Joseph&lt;br&gt;Junior Larson, and Everett&lt;br&gt;Junior Pact, all held in Fort&lt;br&gt;Worth.</description>

      <description>May I offer my appoligizes for the infrenquency of my response.  I have been unable to obtain support for what I have been told about he burial site of Mr Dixon, but today we were visiting our family's plot &amp;amp; there we have found Sim Dixon's head stone disturbed.  &lt;br&gt;&lt;br&gt;Not suggesting that the initial enturement of Sim Dixon was correct or not, someone has moved his headstone alignment  with the rest of the cemetery. &lt;br&gt;&lt;br&gt;I am trying to contact the local folks on this matter, but have not been able to find a contact point as of this evening. Martha, and her children have Choctaw role numbers.  They were origional enrollees.I would like to know more about where you are from, and who your parents are. Phillips is a gentle man of scholarly appearance.  His&lt;br&gt;hair is snow white, and his face bears the etch of his frequent smile.  He probably is one&lt;br&gt;of the last persons anyone whould pick out as the real-life prototype of a television&lt;br&gt;marshal.&lt;br&gt;&lt;br&gt;Yet, this same Jesse Phillips was one of the first sheriffs elected to office after &lt;br&gt;Oklahoma became a state.  He, in fact, is the only living member of the&lt;br&gt;first county slate of officers elected in Atoka County back in 1907.&lt;br&gt;&lt;br&gt;He has the distinction of being the only man now living who was sheriff&lt;br&gt;of a county that first year of statehood.&lt;br&gt;&lt;br&gt;He shared the distinction with John E. Johnson of Sequoyah County for years until&lt;br&gt;Johnson's death about two weeks ago.&lt;br&gt;&lt;br&gt;The retired McAlester man is still big - 6 feet 2 and a firm 210 pounds - but is no where&lt;br&gt;near the 270 - pound giant he was in post-Territorial days.&lt;br&gt;&lt;br&gt;"I was pretty much a peace-maker, even before I was elected sheriff," Phillips will tell&lt;br&gt;you with a smile.  "I didn't have to wear a gun too much, but I had three stashed away&lt;br&gt;at strategic places in Atoka just in case I needed one.  I went after a few toughs, and I&lt;br&gt;always came back with then."&lt;br&gt;&lt;br&gt;A native of Tishomingo County, Miss., where he was born Feb. 18, 1882, Phillips moved to&lt;br&gt;Caddo, Blue County, Choctaw Nation, Indian Territory, when he was 16.  His father, &lt;br&gt;Gray W. Phillips was in the mercantile business in Burnsville, Miss.&lt;br&gt;&lt;br&gt;"We were Mississippi Choctaws, and we came to Indian Territory to be Choctaws," the&lt;br&gt;octogenarian relates with a smile.  "The court ruled otherwise, so my father abandoned&lt;br&gt;his hope of getting a big land acreage and opended a store at Caddo, now in Bryan County."&lt;br&gt;&lt;br&gt;When he was 21, the younger Phillips bought a grocery store at Caney, Atoka County, with&lt;br&gt;his father's help.&lt;br&gt;&lt;br&gt;"There was no organized law in Territorial days," Phillips recalls.  "When a drunk&lt;br&gt;wandered into a store, the owners would call me to come and throw him out.  I was a &lt;br&gt;pretty big, rough boy."&lt;br&gt;&lt;br&gt;Phillips was operating his grocery store at Caney when statehood came.  His father wanted&lt;br&gt;Jesse to run for county treasurer, but the strapping young merchant, then 25, decided he'd&lt;br&gt;rather be sheriff.  He was one of five candidates for the first badge Atoka County was to&lt;br&gt;bestow on the victor.&lt;br&gt;&lt;br&gt;"I polled 992 votes, only six of which came from the county seat," the McAlester man said.&lt;br&gt;"Election night, I went home, thinking I had lost.  Friends woke me up about 3 o'clock&lt;br&gt;the next morning and told me I was sheriff.  I had beaten out me next closest opponent by&lt;br&gt;91 votes."&lt;br&gt;&lt;br&gt;If women and Negroes had been permitted to vote, Phillips' opponent likely would have won&lt;br&gt;the election, since his plurality in Atoka would have been much greater.&lt;br&gt;&lt;br&gt;The new sheriff had two regular deputies, Tom Hosmer and Otis Presson, both now deceased.&lt;br&gt;Presson later was superior judge in Seminole County.  Phillips drew $2,000 a year as&lt;br&gt;sheriff, while his deputies worked entirely on commission.&lt;br&gt;&lt;br&gt;And to make certain county officials were not over-paid, banks discounted their monthly&lt;br&gt;warrants anywhere from 10 to 20 percent.  Sheriff Phillips made money on his feed allowance&lt;br&gt;for prisoners.  He received 60 cents a day for each of the first 10 prisoners in jail; 50&lt;br&gt;cents a day for eah of the next 10, and 40 cents a day for feeding each inmate numbering&lt;br&gt;above 20.&lt;br&gt;&lt;br&gt;"I kept them out to work gangs," Phillips relates.  "Most of the crimes were misdemeanors,&lt;br&gt;but I took the view I was in office to enforce the law.  Outside work contractors would &lt;br&gt;feed my prisoners for 25 cents a day, so I made a good profit in the difference between&lt;br&gt;what the county paid in feed allowance and what it actually cost.  Due to the fact most of&lt;br&gt;the crimes in the early 1900's were horse stealing, bootlegging and the like, Phillips&lt;br&gt;figures his duties were not too difficult.&lt;br&gt;&lt;br&gt;"I had heap rather been sheriff then than to hold the same job now," he said earnestly.&lt;br&gt;&lt;br&gt;Phillips took office in November 1907.  He was re-elected to a second term in 1910, then&lt;br&gt;retired voluntarily to serve two appointments by President Woodrow Wilson as postmaster&lt;br&gt;at Atoka.&lt;br&gt;&lt;br&gt;While Phillips was postmaster, Bob Sumpter, a Republican, was elected sheriff.  Phillips'&lt;br&gt;friends talked him into running against Sumpter in 1919, and the erstwhile sheriff won a&lt;br&gt;third term.  Sumpter later became deputy U.S. marshal and was killed by moonshiners in&lt;br&gt;Coal County.&lt;br&gt;&lt;br&gt;An old political opponent, the laste O.P. Ray, unsealed Phillips as sheriff when the latter&lt;br&gt;sought a fourth term.  Phillips returned to the grocery business in Atoka, but shortly &lt;br&gt;thereafter opened stores at Maud and Shawnee during the oil boom of the&lt;br&gt;mid-1920's.&lt;br&gt;&lt;br&gt;In 1929, Phillips was named by Gov. W.J. "Bill" Holloway as assistant deputy warden of the&lt;br&gt;state prison under Warden John Q. Newell.  He was there for six years, going out during &lt;br&gt;the E.W. Marland adminsitration.  When Leon C. Phillips became governor, the early-day&lt;br&gt;peace officer was named deputy warden of the penitentiary under Warden Jess Dunn.  After&lt;br&gt;1 1/2 years, he was named superintendent of the boys' training school at Stringtown.&lt;br&gt;&lt;br&gt;Phillips was named postmaster of McAlester on Sept.1, 1943, and served in the office until&lt;br&gt;his retirement at age 70 in 1952.  He then went back to the penitentiary for four years&lt;br&gt;as assistant deputy warden under the late H.C. McLoud.&lt;br&gt;&lt;br&gt;Two of the 80-year-old's brothers and one sister are still living.  They are John A. Phillips,&lt;br&gt;Durant, former sheriff and assessor in Bryan County; Graover C. Phillips, McAlester, one-time&lt;br&gt;treasurer of Atoka County, and Mrs Martha White, Berryville, Ark.&lt;br&gt;&lt;br&gt;Phillips' son, Ferman, served three terms in the legislative house and two terms in the&lt;br&gt;senate from Atoka County before becoming secretary of the Oklahoma Education Association.&lt;br&gt;There also are two grandchildren and seven great-grandchildren.&lt;br&gt;&lt;br&gt;Bits and pieces of interesting information keep popping into Phillips' stories about law&lt;br&gt;enforcement in years past.  The former Atoka County sheriff attended the first Oklahoma&lt;br&gt;sheriffs' convention at Oklahoma City in 1908, for instance.  And much of his work right&lt;br&gt;after statehood was done from a buggy, and the sheriff, unlike TV marshals, rarely wore&lt;br&gt;a pistol and holster.&lt;br&gt;&lt;br&gt;"I could tell some tales of death and violence, but they seem out of place now," Phillips&lt;br&gt;said.       <description>I have been researching John McIntyre b.abt.1830 in NC, d.1899 in Palo Pinto, TX.  His first wife was Mary Jane Buchanan who died in Meeker County, MN in 1872. His second wife was Loudema Wright who died in 1926 in Palo Pinto, TX. After John McIntyre died, Loudema applied for a widow's pension based on her husband's service in Co. A, 39th KY.Inf. USA, 1862-1865. The pension file contains a sworn affidavit dated 13 Aug 1900 from Bill McIntire, McAlester, Oklahoma which states that he is 46 years old, he is the son of John McIntyre by his first wife Jane Buchanan who died in Meeker County, Minnesota in January 1872.  His father was subsequtly married to Loudema Wright who is now his widow. His father never married but the twice.</description>

      <description>I am Janna Wickham. I would love to have that information. &lt;br&gt;My great grandfather was washington Tilford Middleton,born in Tenn in 1834. I believe his father was Washington Middleton, born in 1801 in Tenn.  My grandfather WT Middleton was supposedly moved from E Tenn to W Tenn, to Illinois, then to Missouri &amp;amp; finally to Tex in the 1880s.  He was a confederate calvaryman.  I was told he had twin bros.  One was John.  He was killed by Belle Star.  His twin in retaliation, killed Belle Star.  I haven't personally verified this info.</description>

When the officers refused&lt;br&gt;to regard Baber's order to "stand back," Baber opened&lt;br&gt;fire with a double barrelled shotgun loaded with&lt;br&gt;buckshot.  Davidson, with a six shooter in his hand&lt;br&gt;was killed outright and Plank died in a few minutes&lt;br&gt;after being shot.  Neither officer fired at Baber so&lt;br&gt;far as is known.&lt;br&gt;&lt;br&gt;Wilkinson took refuge behind a tree and after two shots&lt;br&gt;had been fired at him escaped.&lt;br&gt;&lt;br&gt;Baber immediately notified police headquarters of what&lt;br&gt;he had done and asked that an officer be sent to arrest&lt;br&gt;him.  Baber was arrested by Chief of Police Burns and&lt;br&gt;Patrolman Bewley.  At police headquarters Baber talked&lt;br&gt;freely of the shooting, protesting that he fired to &lt;br&gt;protect his home.&lt;br&gt;&lt;br&gt;Inquests over the bodies of the dead&lt;br&gt;&lt;br&gt;(CONTINUED ON PAGE TWO)&lt;br&gt;&lt;br&gt;DEPUTY MARSHALS KILLED AT TULSA&lt;br&gt;&lt;br&gt;(CONTINUED FROM PAGE ONE)&lt;br&gt;&lt;br&gt;officers will be held Friday.  Officer Wilkinson, Baber&lt;br&gt;and Baber's wife will be the principal witnesses.&lt;br&gt;&lt;br&gt;Marshal Davidson has been in charge of the government&lt;br&gt;liquor officers here for a year and has been very active&lt;br&gt;in the work of raiding whisky traffickers.  He was a&lt;br&gt;candidate for sheriff of Creek county.  Deputy Plank&lt;br&gt;formerly was a deputy sheriff at Claremore and his&lt;br&gt;people live in Claremore.&lt;br&gt;&lt;br&gt;Excitement over the killing reached the fever point&lt;br&gt;Thursday night, when a score of speakers addressed an&lt;br&gt;indignation mass meeting of 2,000 people, held on a&lt;br&gt;downtown corner.  The result of the meeting was the&lt;br&gt;sending of a telegram to Governor Lee Cruce, signed by&lt;br&gt;citizens, urging him to send Adjutant General Frank M.&lt;br&gt;Canton here with the power to put a ban on bootlegging&lt;br&gt;and gambling.  This telegram was ratified by the&lt;br&gt;meeting enmasse.&lt;br&gt;&lt;br&gt;Federal Aid Sought&lt;br&gt;&lt;br&gt;A telegram signed by fifty members of the Law Enforcement&lt;br&gt;club was sent to United States District Attorney&lt;br&gt;Linebaugh, demanding that Chief Larson of the department&lt;br&gt;of justice and as many deputies as necessary be dispatched&lt;br&gt;to Tulsa with orders to close all whisky traffic at any&lt;br&gt;cost.  It was suggested that at least twenty-five special&lt;br&gt;United States officers be stationed here immediately.&lt;br&gt;Action by the government is expected immediately.  General&lt;br&gt;conditions in Tulsa were denounced by a score of speakers.&lt;br&gt;It was declared by one that Tulsa, as it now is, is not a&lt;br&gt;fit place for children to be reared.  Rev. Lloyd, pastor of&lt;br&gt;the First Baptist church, said:&lt;br&gt;&lt;br&gt;"Unless immediate steps are taken to renovate this city, to&lt;br&gt;reclaim it from the element now standing high, the better&lt;br&gt;people are going to move away.  People are not going to rear&lt;br&gt;their children here: they are afraid to."&lt;br&gt;&lt;br&gt;Others in similar terms flayed what they claimed were existing&lt;br&gt;conditions.  Members of the Law Enforcement club have prepared&lt;br&gt;to offer at the meeting proof that gambling and bootlegging&lt;br&gt;are carried on in the city.  As a result of the killing of&lt;br&gt;the government officers and the mass meeting Thursday night&lt;br&gt;a great crowd of reformers will be present at the session of&lt;br&gt;the commissioners.&lt;br&gt;&lt;br&gt;Telegram to Governor&lt;br&gt;&lt;br&gt;The following telegram, signed by two hundred citizens and&lt;br&gt;ratified by the mass meeting of two thousand, was sent to&lt;br&gt;Governor Lee Cruce:&lt;br&gt;&lt;br&gt;"Governor Lee Cruce, Oklahoma City, Okla.  Sir:  Today&lt;br&gt;Holmes Davidson, deputy United States marshal, and his&lt;br&gt;assistant, Ed Plank, were killed in cold blood by &lt;br&gt;Bill Baber, notorious bootlegger of Tulsa.&lt;br&gt;&lt;br&gt;"It appears that this murder was unquestionably done in&lt;br&gt;pursuance of a conspiracy to kill.&lt;br&gt;&lt;br&gt;"A condition exists in this community which can no longer&lt;br&gt;be tolerated.  We do not expect any assistance or law&lt;br&gt;enforcement from our county officers, therefore we appeal&lt;br&gt;to you, as governor of the state of Oklahoma.  Law&lt;br&gt;enforcement is a farce and lawbreakers laugh at a righteous&lt;br&gt;public indignation.  We must have relief instanter, and&lt;br&gt;respectfully ask that you use every power and authority&lt;br&gt;vested in you as governor of this state to see that the&lt;br&gt;laws are enforced in this community and that crime and law&lt;br&gt;violation, practically licensed by our officers, be&lt;br&gt;suppressed by any and every authority you possess as&lt;br&gt;governor.  A petition to that effect is before you for action.&lt;br&gt;&lt;br&gt;"We appeal to you to enforce the law.  We would be glad if&lt;br&gt;you would send General Canton here at once with full authority&lt;br&gt;to act.  We respectfully request that you act at once,&lt;br&gt;positively and effectually.  Will you act?  The above telegram&lt;br&gt;was read at a mass meeting of two thousand people and ratified&lt;br&gt;by them.  (Signed).&lt;br&gt;&lt;br&gt;"J.A.       <description>He was also my ggrandfather.  He was married to Martha Estep (Brashiers).  He is buried beside her in the Northtown cenetery.  After he was killed his deputy went after the man and killed his and then married Martha.  His name was EDwards.  He is also buried there as is Martha's father Ivy Estep a dr in Union army.  He had a great big tall headstone giving the number of the army.  I am a grandaughter of Arthur Stanton.</description>

He had been night marshal at&lt;br&gt;Carnegie since February.&lt;br&gt;&lt;br&gt;He had lived in the Stuart vicinity for a number of years.&lt;br&gt;He was born June 4, 1902 at Beeville, Texas. Jobe&lt;br&gt;told him not to drive, and there was a scuffle over&lt;br&gt;the car keys.  The scuffle turned into a fist fight&lt;br&gt;and Walters who weighed 220 pounds, loosened some of&lt;br&gt;Jobe's teeth.&lt;br&gt;&lt;br&gt;The marshal said he then tried to put Walters under&lt;br&gt;arrest but the latter shoved his right hand in his&lt;br&gt;pocket and continued to pummel Jobe with his left.&lt;br&gt;&lt;br&gt;Jobe said he drew his pistol and shot Walters in the&lt;br&gt;leg, without apparent effect, and then shot him in&lt;br&gt;the chest and temple, killing him.  Two pocket knives&lt;br&gt;were found later in Walters' pocket, Jobe said.&lt;br&gt;&lt;br&gt;</description>

John&lt;br&gt;Garretson of Delaware is dying with a bullet hole&lt;br&gt;through his head. The funeral&lt;br&gt;services were held at the Baptist church at 2 p.m., conducted&lt;br&gt;by the Rev. D.E. Millichamp.  The Modern Woodmen lodge, of &lt;br&gt;which young Odom was a member, attended in a body.  All the&lt;br&gt;business houses were closed for two hours.&lt;br&gt;&lt;br&gt;Herman Odom was 22 years old.  He has been in this country&lt;br&gt;for a number of years and for two years has been doing service&lt;br&gt;for his father as a deputy.  He was well known and popular.&lt;br&gt;&lt;br&gt;The body of Edward Baum, city marshal, who was killed in the&lt;br&gt;battle Thursday evening, was shipped to Fort Smith, his former&lt;br&gt;home, for interment.&lt;br&gt;&lt;br&gt;</description>

Wilson and Frank McGlothlin,&lt;br&gt;deputy United States marshals, indicted for first degree&lt;br&gt;murder for the killing of the Rev. Sylvester Morris.  The&lt;br&gt;officers will be compelled to remain in the federal jail at&lt;br&gt;Muskogee until their trial, which may be heard in a state&lt;br&gt;court.&lt;br&gt;&lt;br&gt;The Rev. Mr. Morris was mistaken by the officers in the dark&lt;br&gt;here for a bootlegger several months ago, as he was returning&lt;br&gt;home from the country and was shot and killed when he failed&lt;br&gt;to halt at the word of command.  He was quite deaf, which it&lt;br&gt;is believed was the reason he failed to obey the officers&lt;br&gt;command.  He was a retired Methodist minister and wealthy.&lt;br&gt;&lt;br&gt;</description>
