Marshal Jim SMITH of Wynnewood Shot in 1904 Indian Territory

...from Tha Byars Banner newspaper archives in Byars, McClain County, OK, dated:

The Byars Banner
10-20-1904

USED A CLEAVER

A Cook in a Shawnee Restaurant Attacks Wynnewood's Marshal

SHAWNEE: Jim Smith, city marshal of Wynnewood was struck on the
head with a cleaver at the English Kitchen, a big eating house
on East Main street and received injuries which will cause his
death.

Smith came here on business and after transacting it, stopped
at the English Kitchen for a meal, on his way to the depot. With
another officer, he was near the rear of the restuarant apparently
in good shape but arose from his seat when he heard a voice in the
kitchen, at the rear, with a remark that he recognized the voice,
and wanted to see the speaker. As he entered the kitch, the cook,
Jack Jordan, faced him, ordered him out, with an oath and then threw
a heavy cleaver at him. Smith was struck on the head. His skull
was crushed above the left eye for a distance of four inches. The
officer with Smith grabbed the assailant and turned him over to the
police. Jordan is being held in jail, under heavy guard.

Smith was picked up and carried to a room, where the skull was
raised off his brain, and his wound dressed but it is thought that
he cannot recover. Smith is a young man, quiet and unusually well
behaved, and the only theory of the police is that he thought he
recognized Jordan as a wanted man and the cook in a moment of rage
threw the cleaver at him.

SHAWNEE: Marshal Jim Smith died from the effects of his injuries,
and Jack Jordan, cook at the English Kitchen restaurant, has been
placed in jail, without bond. The body of Jordan's victim was
removed to Wynnewood, where burial was made. Jordan, it is
understoof will make a plea of self-defense, declaring that the
murdered man was attemtping to "pull a gun" on him.

***posted for genealogical purposes only; no relation***
The Oklahoman
07-10-1906
Tuesday
p.1/10

TRIPLE MURDER

A FEUD AT CHRISTIE BRINGS ABOUT A HORRIBLE SHOOTING SCRAPE

BROTHERS DIED TOGETHER

One Man Lives With His Body Carrying Two Bullets - Neighborhood is Armed for Further Trouble

Special to The Oklahoman.

Welling, I.T., July 9 - Reuben Kirby is dying, with two bullet
wounds through his body, at his home near Christie in the
Cherokee nation, and brothers, Pleasant Hubbard and Ernest
Hubbard, are dead as the result of a feud that has existed
for some time.

The killing took place at the home of Kirby Saturday afternoon.

This is about four miles from Christie and 25 miles from a
telephone or a telegraph station.

Last Thursday Will Reaves and Frank Kirby, a brother of
Reuben Kirby, got into an altercation and there was a
shooting bee, but no one was killed, though it is
understood that Reaves was badly hurt.

The Hubbard boys took up the quarrel for Reaves.

Saturday afternoon they rode to Kirby's place and opened
fire on Reuben Kirby, probably thinking he was Frank. Kirby
darted into the house as soon as they commenced to shoot
and grabbed his Winchester. Two bullets had already gone
through him. He came out of the door and dropped Pleasant
Hubbard from his horse. Henry slid off on the opposite side
of his horse and Kirby shot through the horse and killed
his man on the other side. There are several families
involved in the feud and it is feared that there will be
more bloodshed.

The fight took place near the famous Rabbit Trap section
where four men were wounded in another shooting scrape ten
days ago and where Ned Christie made his famous stand
against United States officers when he was an outlaw and
his cabin had to be dynamited before he could be gotten out
or killed. There have been many shooting scrapes in that
section of the country.

***posted for genealogical purposes only; no relation***
The shot inflicted
wounds from his head to his feet, some entering his stomach.

Risner was brought immediately to the Durant hospital where the
physicians probed for the bullets. They say there is no chance for
his recovery.

Risner has made a hard fight on the violators of prohibition and it is
thought by the people of Bennington that some law violator was his
assailant. He has been a deputy sheriff for three years and had done
very effective work in stopping law violations in the eastern section
of Bryan county.

***posted for genealogical purposes only; no relation***

Among my mother's treasures was a one-inch newspaper article regarding the murder of her uncle, Claud S. Taylor somewhere near Bennington, Bryan Co., OK in the 1930's but the article did not have the newspaper's name attached.

At any rate, it described that Claud was gunned down on his front porch in the dark of the evening when he went out to check out a strange noise. He left a wife and two young children. His neighbor was a suspect.

Does anyone know about this event or the Taylor Family. Claud's sister was Katie Lee Taylor Wiler. Their parents were James Lee and Florence Phillips (Cherokee) Taylor who resided in Choctaw Nation & Bennington, Bryan Co. OK.

Any help appreciated!
Fort Smith, Judge Roy Parker's cases

http://www.rootsweb.com/~okgenweb/pioneer/index.htm

At the above link my great uncle ( go to hte index and search Oscar Richey) wrote:

My parents were Natives of Arkansas and grew up near Fort Smith which is just across the line from Indian Territory . . . After they were married in the year 1872, they moved into Indian Territory and settled in either the present Sequoyah or Leflore Counties. I do not know on which side of the Arkansas River they lived . . . Mother never ceased to tell us children of an experience which she had while living at that place. Two White men and Two Negroes committed some kind of a crime in the Indian Territory, were taken to Fort Smith tried and convicted and were sentenced to be hanged.

When the day of the hanging came, she and Father like everybody else in the country started early for the hanging was to be a public affair, and they traveled all day through the woods and across the streams and when they reached Fort Smith there were literally a thousand people which was a great number at that time, gathered as if at a picnic to witness the hanging. Mother watched the hanging and it was so horrible to her that she regretted attending such a thing all the remainder of her life.

I was wondering how a person could find a record of the hangings at Fort Smith from about 1872 to 1875 or 6 or 7 or so. I'd like to verify that story, and find a time when 2 whites and 2 blacks were hanged at Fort Smith on the same day, but I don't know how to research it.

Thank you,

Vance Hawkins

Jim Martin shot & Killed Sep 1906 Oswalt Indian Territory OK

I am hoping that some might be able to help me.

I am searching for information on a murder trial. I started with a newspaper clipping from the Ardmoreite newspaper from Sep 11, 1906.

I have not been able to find a follow-up on this story. I have been told by another researcher that at least one of the men or maybe 2, died in prison.

All I had to start with were the names and date. I contacted the National Archives in Ft Worth and they did find this in an index. They gave me a docket #5812 and the correct spelling on the names, but I was told that they do not have the records. This index covered the years 1895 -1907.

They problem seems to be where would the trial have been? Was it Federal or State? The shooting was Sep 10,1906 and since Oklahoma became a state in 1907, I am beginning to think the records might have been transferred from Federal to State.

I have contacted the Court Clerk for Carter Co. as well as Love Co and no one has been able to help so far.

This is what I have:

Docket #5812
Murdered man was James (Jim) Martin Shot and died September 10 1906.
shooters were John Banks, Eldridge Gassoway and W.S. Aderholt
Place was near Oswalt, Indian Territory
The newspaper clipping stated that the "Marshals from Ardmore" were called.

I have checked the web page for Oklahoma Court System and the oldest cases listed there was for 1908. Also, they only list the State courts and I do think this might have been Federal.

I once read (can't remember where) about a trial from Indian Territory that took place in Paris TX. Does this sound right? Or even possible?

I will greatly appreciate any tips or idea's that anyone might have.

Thanks,

Jo Cox

I'm looking for genealogical information on them. I can find biographical information on them as individuals, but nothing that identifies parents, other siblings, or any marriages or children.

Supposedly, a Jennings cousin of theirs married into a Paul family of which a sibling to that individual married a cousin of mine. The source person of this information claimed that this Jennings spouse who married the Paul was related to Al and Frank somehow. Since the people in question lived in SW MO, where KS, OK/IT, and MO come together, they did seem to live in the correct area.

The Paul family involved has General Lafayette Paul as a member. Tracing them hasn't helped me find the Jennings connection.

Beaty killed by outlaws in Oklahoma

Very little is known of Armen Beaty's life since he died so young. His tragic death was all that anyone would remember. Events of his life was long out of memory for those who would be able to recall it for the younger generations that could or would save it for posterity.
Armen was working on a ranch in Ennis, Texas in September 1895. He and others hearded some cattle north into Oklahoma, unknown if it was Indian or Oklahoma Territory and sold them on May 20, 1896. After selling his cattle and while standing near his wagon, several outlaws approached him and demanded the money from the sale. He refused, was shot and killed at the age of twenty five. He was buried near the place he died (unknown location), later his parents had him disinterred and re-buried at Carson Cemetery near Ector, Fannin County, Texas. Since Enis is south of Dallas, it appears that the most direct route to Oklahoma was from Sherman Texas eastward along the Red River to a point north of Bonham Texas. Does this story ring a bell with any one?
Armond Beaty acbeaty@1starnet.com

I have been trying to locate the records of murders in the 1880s. My ggf delivered mail between Denison TX and Durant OK. He was apparently ambushed, robbed and murdered while on a mail run between those two cities. His body was never found. I have contacted NARA, and all I get is a run-around.. No one seems to have the records of crimes committed in that area at that time. Can anyone help me locate Oklahoma criminal records of that era?

His dob 8/16/1845, Georgia; dod 5/30/1896 Fort Cobb, Oklahoma; burial Holcomb Cemetery, Chickasha, Grady Co., Oklahoma. I have seen a photo of his head stone but was not able to read the inscription.
I believe there was an article in the Daily Oklahoman 2/11/1898. The archives from that paper do not go back that far. I believe the trail was for Lizzie Ellis Izaaca.
We are seeking information on our ggguncles, the Blonger Bros., and hoping you'll come see what we have already uncovered:

http://www.BlongerBros.com

The Blonger Bros. were saloon men, gamblers, lawmen, mining tycoons and bunco artists, and at one time were known all over the West. Lou went on to build a huge bunco ring in Denver that lasted almost forty years.

They are a forgotten slice of the West that we are pleased to introduce to the internet.

Has anybody any information on Sheriff Hicks of Oklahoma Territory? He was married to a full-blooded Cherokee (name unknown, but she died in Northern California in the 60's or 70's). Their son was James Hicks (Tubby), and their granddaughter was Idella Jane Hicks.

Idella's grandmother told her that her husband was ordered to go after some outlaws in the badlands of Oklahoma. He refused and turned in his badge. My Auntie Della always laughed over that so much - said her grandpa wasn't any fool. :0)

It's difficult to ascertain the time frame, but a clue is in the birthdate of Idella which was 1927 and her dad's in the late 1800's.

update on William Ira Herod

William Ira Herod was born in 1865 in W.Virginia. He left home at the early age of 14, and eventually setteled in Mounds in Indian Territory. He was well thought of and when Okla became a state William Ira Herod was appointed as an United States Marshall in Mounds, Okla.He fulfilled that position for nine yrs. He was also good at Masonary and built alot of the sidewalks in Mounds by himself. He also built the cement benches in the cemetary and one still stands in a yard in Mounds that he built. He was married to Jessie Linkhart and thay had a famiy. He had a brother named Joe Herod who was living and signed Williams death certificate in 1929 from natural causes.William Ira was Cherokee Indian although he did not dress the part as one might imagine and few people realized he was. In those days people were extremly prejudice.Mounds is trying to get a historical society in the old Mounds Library and there will be a picture and more of his life there. The old jail is still across the street and Mounds is a nice little town.K.Herod
