Sorry, you seem to be confusing copyright with plagerism issues.

Also, not making money is not a defense. While making money on something that is still under copyright is more likely to bring you to holder's attention, even giving it away for free is illegal.

Out of print, or dead author does not mean that the item is out of copyright.

Acknowledgeing the source has nothing to do with copyright per se. If anything it makes it easier to prosecute you for violations. Failure to put the source is bad manners, and will cause trouble with say academic research, but is not by itself illegal.
