A book published in the United States in 1908 would be in the public domain in the United States. You could transcribe the whole thing if you wanted and there most likely would never be a problem. Rest assured that any book from 1908 will eventually be digitized some time soon anyways the way things are going these days. The real issue is with post-1923 to 1950s publications that nobody seems to be able to determine how copyright applies.
