Family copyrighting old family photos?

According to a family member, after her mother passed away another family member told everyone that they had her mother's old family photos copyrighted and refuses to share the photos with the rest of the family. These photos were most likely taken between 1910-1940. I know that typically the photographer would own the copyright for the photos. What are the chances that this person was able to obtain copyright for the photos? Is there a way to find out without actually having to ask that person? (Obviously there are some stubborn people in this family, and those who would be highly offended that you even question what they say.)
